SUBJECT: Establishment of a Biennial Audit Period for Silver Creek Drainage District

RECOMMENDED ACTION(S):
TITLE
Adopt Resolution authorizing the Silver Creek Drainage District (the "District") to replace its annual audit with a biennial audit covering a two-year period (a unanimous vote is required under Government Code, ? 26909, subdivision (b)).
REPORT
Approval of the recommended action will authorize the Silver Creek Drainage District to replace its current annual audit with a biennial audit. Such approval will result in a reduction in audit costs to the district. The Silver Creek Drainage District falls within District One.

ALTERNATIVE ACTION(S):

If the recommended action is not approved, the Silver Creek Drainage District will not be able to conduct biennial audits. This will result in the District not being able to reduce its audit costs going forward.

FISCAL IMPACT:

There is no fiscal impact to the County of Fresno.

DISCUSSION:

Government Code Section 26909 (b)(1) allows a special district to replace the annual special district audit with a biennial audit covering a two-year period. This code section requires a unanimous request of the special district's governing board and unanimous approval of the Board of Supervisors to implement the biennial audit period. Approval of the resolution will result in reduced audit cost to the district.

The Auditor-Controller/Treasurer-Tax Collector recommends approval of the resolution to request the biennial audit period. The District's Board of Directors approved such resolution unanimously on May 16, 2024. The District's most recent annual audit date is unknown due to a fire that destroyed all pertinent documentation, followed by a period of over 20 years of inactivity. Therefore, the initial two-year audit will cover the period of July 1, 2024 through June 30, 2026.
