SUBJECT: Appointment of a Director to Mercy Springs Water District in accordance
with Government Code section 1780(h)(1)
RECOMMENDED ACTION(S):
TITLE
Appoint Palmer McCoy to the Mercy Springs Water District Board of Directors for a term expiring December 6, 2024, to fill a vacancy.
REPORT
As permitted by California Government Code section 1780, subdivision (h)(1), approval of the recommended action will allow your Board to provide the Mercy Springs Water District (District) Board with a quorum by appointing a director to one of the District Board's vacancies. This item pertains to District 1.
ALTERNATIVE ACTION(S):
If the recommended action is not approved, the District Board may continue to be unable to meet and conduct its business.
FISCAL IMPACT:
There is no increase in Net County Cost associated with the recommended action.
DISCUSSION:
There are five (5) seats on the District Board. Due to the recent resignation of Director Michael Linneman on July 29, 2024, only two (2) directors remain to serve, and the District Board will be unable to meet and conduct its business due to a lack of a quorum.
On June 20, 2024, the District notified the Clerk of the Board's office of their current difficulties with achieving a quorum due to Director Linneman's illness and requested your Board appoint Palmer McCoy to one of the vacant positions. The District has submitted documentation supporting Mr. McCoy's qualifications to serve on the District Board.
On July 30, 2024, the District provided the Clerk of the Board's office with Director Linneman's resignation letter dated July 29, 2024, which notes his resignation as effective immediately.
If appointed by your Board, Mr. McCoy will serve for a term to expire on December 6, 2024.
