SUBJECT:                     Amendment II to Agreement with City of Selma for the Sidewalk Connectivity Project Phase III (CDBG 24651)

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute Amendment II to Agreement No. 24-496 with City of Selma for the Sidewalk Connectivity Project, Phase III, Community Development Block Grant (CDBG) Project No. 24651, effective upon execution with no change in term through March 20, 2026, increasing the maximum CDBG funds provided by $229,303, due to increased construction costs, to a total CDBG funding amount not to exceed $530,560.

REPORT

There is no Net County Cost associated with the recommended action. Approval of the recommended action will provide additional Community Development Block Grant (CDBG) funding for the Selma Sidewalk Connectivity, Phase III (Project). These additional funds are available from the City of Selma (City) CDBG allocation included in the County’s 2025-2026 Action Plan, approved by your Board on August 5, 2025, and are being reallocated from the City’s Phase IV project to Phase III. The total Project cost is now estimated at $530,560. This item pertains to a location in District 4.

 

ALTERNATIVE ACTION(S):

 

Your Board may choose not to approve the recommended amendment, requiring the City to provide local financial contributions to cover Project costs that exceed the current $301,257 CDBG funding provided in the agreement, as previously amended. Using the funds initially planned for Phase IV will delay the expenditure of those funds, potentially impacting the County’s ability to meet its CDBG expenditure timelines, set by the U.S. Department of Housing and Urban Development (HUD).

 

FISCAL IMPACT:

 

There is no Net County Cost associated with the recommended action. The recommended amendment will increase CDBG funding for the Project by $229,303, from $301,257 to $530,560. The additional CDBG funds are included in the Department of Public Works and Planning - Community Development Block Grant Org 7205 FY 2025-26 Adopted Budget. CDBG funds are provided on a reimbursement basis.

 

DISCUSSION:

 

On September 10, 2024, the Board approved Agreement No. 24-496 (Agreement) for the Project, then estimated at $232,796. The Agreement provided $232,796 in CDBG funds to the City, on a reimbursement basis, for the construction or replacement of curb, gutter, sidewalk, drive approaches, and curb ramps where missing, damaged, or not meeting current American with Disabilities Act (ADA) requirements to create a safe continuous pedestrian traveling surface. Existing signs, placement markings, curb, gutter, sidewalk, drive approaches, streetlights, storm drain inlets, and landscape may be modified, replaced, and/or relocated to accommodate the proposed improvements. The Project is located in the City of Selma within the area generally bounded by Valley View Avenue, to the south, Second Street and Bauder Street to the north, Thompson Avenue to the west, and Sheridan Street to the east.

 

On July 8, 2025, your Board approved Amendment I, which increased the total CBDG funds allocated to the Project by $68,461, from $232,796 to $301,257.

 

On September 18, 2025, the City opened bids for the Project, which included additive alternate bid items If approved, Amendment II will increase the total CDBG funds allocated to this Project from $301,257 to $530,560, allowing the funding for construction of all bid items in a timely manner. If the recommended amendment is not approved, the City will not award the additive bid items and will include those in Phase IV. Reallocating funds between projects listed in the Annual Action Plan is considered a minor amendment and does not require noticing or a separate formal action by your Board. Adding or deleting a project from the Annual Action Plan is considered a substantial amendment; Phase IV is not being deleted at this time, as any CDBG funds remaining at the completion of this Project may be used to start Phase IV under a separate Agreement to be brought before your Board. All remaining provisions of the Agreement will remain in full force and effect.
