SUBJECT:                     Second Amendment to Interdepartmental Agreement for American Rescue Plan Act - Coronavirus State and Local Fiscal Recovery Funds

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute a Second Amendment to Interdepartmental Agreement No. A-24-577 between the General Services Department, Information Technology Services Department, County Administrative Office, and Department of Public Works and Planning to re-assign $70,435 of $10,701,183 in available American Rescue Plan Act - Coronavirus State and Local Fiscal Recovery Funds (ARPA-SLFRF) between programs, with no change to the term of April 19, 2022, through December 31, 2026.

REPORT

There is no increase in Net County Cost associated with the recommended action, which will authorize the Chairman to execute a Second Amendment to the Interdepartmental Agreement (Agreement) between the General Services Department (GSD), Information Technology Services Department (ITSD), County Administrative Office (CAO), and the Department of Public Works and Planning (PWP). Approval of the recommended action will revise language in Exhibits A-1, B-1, and E-1 to address changes in project scopes, correct a minor discrepancy, and reassign $70,435 in cost savings from GSD’s Program No. 7, HVAC Systems and Electrical Maintenance and Repairs to Downtown County Public Facilities to GSD’s Program No. 1, HVAC Improvements at Certain Essential County Facilities. This item is countywide.

 

ALTERNATIVE ACTION(S):

 

There are no viable alternative actions. The recommended Amendment aligns with direction from the CAO for use of ARPA-SLFRF as appropriated under the County’s expenditure plan.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended action. Sufficient appropriations and estimated revenues are included in the FY 2025-26 Adopted Budget for GSD-Facility Services Org 8935 and ITSD Org 8905. The projects are fully funded with ARPA-SLFRF, which will be reimbursed from the Auditor-Controller/Treasurer-Tax Collector Org 1033 - Disaster Claiming, Fund 0026, Subclass 91021.

 

DISCUSSION:

 

On November 5, 2024, the Board approved the Agreement between the Internal Services Department (ISD), CAO, and PWP to complete projects funded through ARPA-SLFRF related to the modernization of heating, ventilation, and air conditioning (HVAC) units at various County facilities serving the public (Program No. 1); the upgrade and/or replacement of the emergency electrical systems (back-up power sources) at the Department of Public Health’s Brix-Mercer building (Program No. 2); the purchase of communication improvements for public facilities (Program No. 3); improvements in support of improved ventilation at the Facility Services Headquarters (Program No. 8); and allow for necessary ventilation design and engineering, improvements, inspections, maintenance, and repairs to the HVAC systems, as well as generation and electrical maintenance and repairs to emergency generators at downtown public facilities (Program No. 7).

 

On January 28, 2025, your Board approved the reorganization of the Internal Services Department into two separate departments, GSD and ITSD, which took effect February 28, 2025.

 

On August 19, 2025, your Board approved an amendment to the County’s ARPA-SLFRF expenditure plan, which among various actions your Board redesignated $506,000 in cost savings within GSD’s programs to help address anticipated cost overruns in GSD’s Program No. 1.

 

On September 23, 2025, your Board approved the first amendment to the Agreement, which memorialized the redistribution of the ARPA programs between GSD and ITSD, and reassigned $506,000 of the available $10,701,183 between GSD’s programs.

 

Since approval of the first amendment, significant progress has been made to complete the initial tasks established for Programs No. 1, 2, and 7. The recommended Amendment will revise language in Program No. 1 (Exhibit A-2) to clarify which public facilities are eligible for funding and increase the total funding available by $70,435 from cost savings identified from Program No. 7; these cost savings will address additionally identified HVAC subprojects that qualify for reimbursement under ARPA-SLFRF. The recommended Amendment will also update the funding for Program No. 2 (Exhibit B-2) to address a $0.45 discrepancy and correct this for accounting and obligation purposes. Finally, the recommended Amendment will revise the language in Program No. 7 (Exhibit E-2) to authorize GSD to use ARPA-SLFRF for additional and necessary mechanical, power, and electric improvements that have been identified for downtown public facilities.
