Title: 1. SUBJECT:                     Revised CalRecycle Farm and Ranch Solid Waste Cleanup and Abatement Grant Program Resolution

 

RECOMMENDED ACTION(S):

TITLE

1.                     Adopt revised Resolution (a) authorizing the submittal of applications for the Farm and Ranch Solid Waste Cleanup and Abatement Grant Program, administered by the California Department of Resources Recycling and Recovery, for a period of five years from date of adoption of said Resolution; and (b) authorizing the Chairman to execute all grant agreements and amendments thereto; and,

 

2.                     Authorize the Director of the Department of Public Works and Planning, or designee, as the designated Signature Authority for all other documents necessary to secure grant funding and implement grant-related activities.

REPORT

Approval of the recommended actions will replace Resolution No. 17-536, adopted by the Board on December 5, 2017.  The recommended resolution allows the County to meet the California Department of Resources Recycling and Recovery (CalRecycle) grant program regulations for application and administration for the Farm and Ranch Solid Waste Cleanup and Abatement Program (Program).  The Program provides funding to cleanup illegal solid waste sites on farm or ranch property.  This item is countywide.

 

ALTERNATIVE ACTION(S):

 

Your Board may choose not to adopt the recommended resolution, making the County ineligible to participate or receive grant funds for the Program.

 

FISCAL IMPACT:

 

There is no Net County Cost associated with the recommended actions.  Grant funds awarded will pay for work related to the cleanup of illegal solid waste sites on qualified farm or ranch properties.  Should the County be awarded funding, Department staff will return to the Board with the appropriate budget resolutions.

 

DISCUSSION:

 

On December 5, 2017, the Board adopted Resolution No. 17-536, which inadvertently contained conflicting language regarding signature authority.  Due to the text discrepancies, Department staff is presenting a revised Program resolution for adoption. 

 

CalRecycle administers the Program to provide funding to cleanup illegal solid waste sites on farm or ranch property.  The property is defined, in Title 14 California Code of Regulations, section 17991 (d), as publicly or privately owned property that is used for rangeland or agricultural activities, and may include appurtenant easements or right-of-ways such as, but not limited to public roads, and utilities.  A site may be eligible for funding if the parcel(s) is(are) zoned for agricultural use, where unauthorized solid waste disposal has occurred, and where the site(s) is(are) in need of cleanup in order to abate a nuisance or public health and safety threat and/or a threat to the environment.

 

The proposed resolution, will allow the County to apply directly for grant funding and/or in partnership with eligible private property owners throughout the County.
