SUBJECT: Correction of Record - Memoranda of Understanding for Representation Units 3, 4, 12, 13, 19, 22, 31, 36, 39, and 43
RECOMMENDED ACTION(S):
TITLE
Approve the corrections to the Memoranda of Understanding for Representation Units 3, 4, 12, 13, 19, 22, 31, 36, 39, and 43.
REPORT
This item corrects typographical errors appearing in recently negotiated Memoranda of Understanding (MOUs) for bargaining units represented by Service Employees International Union (SEIU), Stationary Engineers - Local 39 (Local 39), The Professional Association of Employees (BU19), and the Professional Association County Employees (BU31). The typographical errors reflected a transposition, where “up to $688” should have read “up to $668” for the County contribution to specific health insurance plan selection coverages.
ALTERNATIVE ACTION(S):
While the typographical errors are acknowledged by all parties and do not affect the actual terms and conditions, the contract documents and formal record should be conformed to the negotiated and tentatively agreed upon terms and conditions to avoid ambiguity.
FISCAL IMPACT:
There is no fiscal impact associated with this recommended action.
DISCUSSION:
The successor MOU for Unit 19 was approved by your Board on November 28, 2023. The associated Board Agenda Item (BAI) reflected the correct County contribution of “up to $668” for the “Employee plus Spouse” health insurance plan selection coverage. However, the MOU incorrectly reflected “up to $688” as the County contribution for the “Employee plus Spouse” plan selection. The MOU will be corrected to reflect “up to $668” for the County contribution of the ”Employee plus Spouse” plan selection.
The successor MOUs for Units 31, 39, and 43 were approved by your Board on December 12, 2023. The associated BAIs reflected the correct County contribution of “up to $668” for the “Employee plus Child(ren)” and “Employee plus Spouse” health insurance plan selection coverages. However, the MOUs incorrectly reflected “up to $688” as the County contribution for the “Employees plus Child(ren)” and “Employee plus Spouse” plan selections. The MOUs will be corrected to reflect “up to $668” for the County contribution of the “Employee plus Child(ren)” and “Employee plus Spouse” plan selections.
The successor MOUs for Units 3, 4, 12, 22, and 36 were approved by your Board on January 23, 2024. The associated BAI did not refer to the specific County contributions to health insurance plan coverages. However, the MOUs incorrectly reflected “up to $688” as the County contribution for the “Employees plus Child(ren)” and “Employee plus Spouse” plan selections. The MOUs will be corrected to reflect “up to $668” for the County contribution of the “Employee plus Child(ren)” and “Employee plus Spouse” plan selections.
The successor MOU for Unit 13 of Local 39 was approved by your Board on January 23, 2024. The MOU and its associated BAI incorrectly reflected “up to $688” as the County contribution for the “Employee plus Child(ren)” and “Employee plus Spouse” plan selections The MOU will be corrected to reflect “up to $668” for the County contribution of the “Employee plus Child(ren)” and “Employee plus Spouse” plan selections.
All impacted bargaining units have been notified and have formally agreed that the typographical errors have no impact to the negotiated and tentatively agreed upon terms and conditions. The typographical errors will be corrected appropriately and have been agreed upon in countersigned documents, attached.
