SUBJECT:                     Retroactive First Amendment to Agreement with the City of Clovis

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute a retroactive First Amendment to Agreement No. 24-583 with the City of Clovis to continue to assign one sworn Police Officer and one Crime Specialist, and to provide training services to the Public Safety Realignment Adult Compliance Team, effective July 1, 2024, through June 30, 2029, and increasing the Agreement maximum by $691,907 to a total of $1,343,173.

REPORT

The City of Clovis will continue to provide one sworn Police Officer and one Crime Specialist to participate as members of the Public Safety Realignment Act (Assembly Bill 109) Adult Compliance Team (ACT). Agreement No. 24-583 requires an annual budget approval from the Community Corrections Partnership (CCP) executive committee to ensure continued funding. An item will be brought to the Board each year for final approval to ensure the necessary funds are allocated. Although the recommended Amendment is with the City of Clovis, which is in District Five, this item is countywide.

 

ALTERNATIVE ACTION(S):

 

If the recommended action is not approved, the ACT will not include a Police Officer and a Crime Specialist from the City of Clovis, or the required training for all ACT members.

 

RETROACTIVE AGREEMENT:

 

The recommended Amendment is retroactive to July 1, 2025, due to your Board’s approval of the County’s FY 2025-26 budget on September 15, 2025, which included the Department’s allocation for this recommended Amendment. The City of Clovis executed the recommended Amendment in September of 2025, and it is being brought before your Board on the first available date within the agenda item processing deadline.

 

FISCAL IMPACT:

 

There is no Net County Cost associated with the recommended action. The cost of $691,907 for the recommended Amendment is funded with AB 109 funds ($618,607 plus $73,300 for ACT Training and equipment) received from the State of California. Sufficient appropriations and estimated revenues for these services are included in Probation’s FY 2025-26 Adopted Budget for Org 3430.

 

DISCUSSION:

 

The Adult Compliance Team (ACT) is a multi-agency unit created under Assembly Bill (AB) 109 to enhance supervision and public safety addressing public safety concerns and issues facing local law enforcement in Fresno County. The ACT enforces conditions of probation, conducts compliance and non-compliance searches of AB 109 probationers who are under the supervision of the Fresno County Probation Department, and provides immediate response to crisis situations. The teams also provide surveillance and warrant sweeps in conjunction with other law enforcement agencies.

 

On November 5, 2024, the Board approved the most recent agreement with the City of Clovis for the assignment of one sworn Police Officer, one Crime Specialist to the ACT, and related ACT training costs in the amount of $651,266 for the term July 1, 2024 through June 30, 2025.

Because the agreement requires annual budget approval, an amendment must be brought forward each fiscal year to update the approved amount.

 

On June 9, 2025 the Community Corrections Partnership (CCP) Executive Committee approved the annual AB 109 budget for fiscal year 2025-26, which included the City of Clovis’ budget in participation of the ACT and training related costs. On September 15, 2025, your Board approved the Department’s Budget which includes the approved FY 2025-26 allocation, increasing the recommended amendment by $691,907, for a new agreement total of $1,343,173.

 

The City of Clovis remains responsible for ACT training and equipment cost, as approved by the Sheriff’s sergeant assigned to the ACT. The City of Clovis is reimbursed for these expenses by the Sheriff’s Office through its Assembly Bill 109 allocation. However, effective FY 2025-26, reimbursement for these expenses has been streamlined and will now be made directly from Probation’s budget to the City of Clovis, rather than through the Sheriff’s Office.
