SUBJECT: Agreement with Fresno County Disc Golf for use of Kearney and Lost Lake Parks for Annual Disc Golf Tournaments
RECOMMENDED ACTION(S):
TITLE
Approve and authorize the Chairman to execute a three-year agreement with two automatic one-year extensions, total five-year term through May 20, 2029, with Fresno County Disc Golf for exclusive and non-exclusive use of Kearney and Lost Lake Parks Disc Golf Courses to host annual disc golf tournaments.
REPORT
Fresno County Disc Golf (FCDG) has requested both exclusive and non-exclusive use of disc golf courses at Kearney Park and Lost Lake Park for annual disc golf tournaments. Tournaments dates will be mutually agreed up by the County and FCDG and are tentatively scheduled for, but not limited to the first Saturday of the month of June (exclusive) and the third Saturday of the month between April and October (non-exclusive). FCDG also desires permission to include collection of tournament registration fees, as well as vendor, food and alcohol sales. There are currently two courses previously constructed by FCDG at Kearney Park as well as a FCDG proposed course to be built at Lost Lake Park. The Department of Public Works and Planning will return to the Board at a later date to request approval for FCDG to install a permanent Lost Lake course. Until a permanent course can be approved and constructed, FCDG would utilize portable baskets and create a temporary 18-hole course at Lost Lake Park. This item relates to property located in District 1 and District 5.
ALTERNATIVE ACTION(S):
Your Board may choose not to approve the recommended action. If the recommended action is not approved, FCDG will not be able to host exclusive/non-exclusive disc golf tournaments at Kearney and Lost Lake Parks to collect tournament registration fees and include vendor, food and alcohol sales. Any potential revenues generated by these proposed tournaments, through vehicle entry fees or purchased parks annual passes, will not be collected by the County.
FISCAL IMPACT:
There is no increase in Net County Cost associated with the recommended action. FCDG estimates that tournament play will increase overall park attendance and may generate more revenue from purchased parks annual passes and daily vehicle entrance fees. With regard to the proposed Lost Lake Park disc golf course, FCDG, at no cost to the County, will provide temporary baskets for the proposed tournaments until a permanent course can be constructed, also at the expense of FCDG. Additionally, FCDG previously established a trust fund with the County for maintenance of the Kearney Park disc golf course.
DISCUSSION:
With the growing popularity of the sport of disc golf in the Central Valley, FCDG wishes to increase usage of these disc courses through tournament play. FCDG will provide all necessary permits, licensing, staffing, equipment, and setup to conduct the event, provide adequate security as determined by Fresno County Sheriff’s Office and California Highway Patrol, provide all cleanup at the conclusion of the event, and reimburse the County for any damages incurred to Kearney or Lost Lake Parks as a result of these tournaments.
FCDG also agrees to the following:
• FCDG acknowledges that the users of the disc golf course remain subject to any and all applicable County rules and regulations for use of County parks, as well as park vehicle entrance fees.
• FCDG agrees/acknowledges that its use and its member’s use is non-exclusive and may not create any interference with nearby park users unless exclusive use of the disc golf courses for tournament activities is permitted.
• FCDG and its members agree to conduct their disc golf activities in a safe and orderly manner.
• FCDG agrees that County may prohibit any disc golf use during special events at the park.
Exclusive use tournaments will allow FCDG to have exclusive use of the disc golf courses solely for the participants registered in the tournament, at either park location. Non-exclusive use tournaments will allow members of the general public to utilize the disc golf courses, at either location, while tournament play is actively happening. Regardless of exclusive or non-exclusive tournament status, the host park will remain open to the public.
