SUBJECT:                     Contract Change Order for Contract No. 20-05-C, Laton Pedestrian and Drainage Improvements, Federal Project No. ATPL-5942(275)

 

RECOMMENDED ACTION(S):

TITLE

Authorize the Chairman to execute a Contract Change Order for Contract No. 20-05-C, Laton Pedestrian and Drainage Improvements, which will increase the contract amount by $97,324.15.  This increase, in addition to previous contract change orders signed by the Director of Public Works and Planning of $47,021.26, will increase the total contract amount from $2,295,015 to $2,439,360.41.

REPORT

Approval of the recommended action will authorize the Chairman to execute contract changes in excess of the Director’s limit of $127,250 necessary to authorize payment for quantities of materials placed, as well as additional finishing work necessary for project acceptance by various regulatory and funding agencies.  This item pertains to a location in District 4.

 

ALTERNATIVE ACTION(S):

 

If the recommended action is not approved, there will not be sufficient contract funds to perform the additional work.  If the additional work is not completed, the State Water Resources Control Board and Caltrans will not allow permit closure or final payment as necessary to close out the project.

 

FISCAL IMPACT:

 

There is no Net County Cost associated with the recommended action.  The Active Transportation Program (ATP) will reimburse 95% of the contract construction costs.  On January 21, 2020, the Board approved Resolution 20-0019 in which the County agreed to pay for utility relocation costs for which Laton Community Services District would otherwise have been legally liable.  At completion of the project, these costs will total $132,498, or 5% of the total project cost.  These costs will be paid for out of the Road Fund.  Sufficient appropriations and estimated revenues are included in the Departments - Roads Org 4510 FY 2021-22 Adopted Budget.

 

DISCUSSION:

 

On October 6, 2020, your Board awarded Contract No. 20-05-C to Emmett’s Excavation, Inc. for $2,295,015 and authorized the Director of Public Works and Planning to execute contract change orders (CCO) up to $127,250.  A Notice to Proceed was issued on November 30, 2020. The project widened existing roadways and constructed new sidewalks, curbs and gutters along Bliss, Murphy, Fowler and Gonser Avenues.  The work also included the relocation of several water meters and potable water lines and removal of 13 trees, as well as construction of an asphalt walkway along Latonia Avenue.  A new storm drainage system also was installed and connected to the existing system to accommodate run-off.  Two culverts were widened to accommodate the pedestrian sidewalk over the Laguna Irrigation District’s canal.  Although the project is substantially complete, a final walkthrough, which included staff from construction, design and maintenance divisions, identified several issues of safety or regulatory compliance that were not apparent on the plans, and could only be identified by inspection of the actual on-site conditions.

 

The change order increases the contract by $69,250.15 to balance the bid items to actual quantities placed, as well as $28,074 for the following extra work: hydroseeding for disturbed slope areas, installation of a fire hydrant extension, additional retro-reflective markers and striping, replacement of “no parking signs” with “no parking on pavement signs” and the addition of 13 ADA transition ramps at the end of sidewalks.  The change order also adds working days to complete the change order work as well as to accommodate material supply delays caused by the COVID-19 emergency.

 

The original completion date was scheduled for June 2021, and completion is now anticipated for November 2021.

 

OTHER REVIEWING AGENCIES:

 

The California Department of Transportation (Caltrans) and the California Transportation Commission allocated funding for this project.  The Laguna Irrigation District and the Laton Community Services District approved the utility relocation plans.
