SUBJECT:                     Resolution Continuing A&J Social Services LLC d.b.a. Special

                     Services Community Center Partnership with the County of Fresno

 

RECOMMENDED ACTION(S):

TITLE

Adopt Resolution recommending licensure for A&J Social Services LLC d.b.a. Special Services Community Center to continue to provide Driving Under the Influence and Drug Diversion Programs services to the County of Fresno.

REPORT

Approval of the recommended action will enable A&J Social Services LLC d.b.a. Special Services Community Center (A&J) to be relicensed through the Department of Health Care Services (DHCS) to continue providing Driving Under the Influence (DUI) and Drug Diversion Programs (PC1000) services for the County. This item is countywide.

 

ALTERNATIVE ACTION(S):

 

If the resolution is not adopted, A&J will no longer be licensed to provide services to the County which may result in extended wait times and delays in participants completing the ordered program due to the remaining programs absorbing a significant number of participants annually, as well as the loss of revenues paid to the County by A&J. A resolution that demonstrates County Board of Supervisors’ support of licensure for A&J is required by DHCS for all licensing applications, and has been requested by A&J.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended action. The County does not pay any compensation to the DUI and PC1000 programs. As the administrator of the DUI and PC1000 programs in Fresno County, the County retains up to 5% of the actual client fees revenue less the State collected fees to offset the County’s administrative program and indirect costs. Actual direct and indirect costs incurred by the County to provide administrative services are 100% financed with the programs’ client fees revenue.

DISCUSSION:

 

On June 20, 2023, the Board approved Master Agreement No. A-23-270 for the provision of DUI and PC1000 services, with various providers to reduce the number of repeat DUI offenses by persons who complete a state-licensed DUI program; and provide participants an opportunity to address problems related to the use of alcohol and/or other drugs. Programs consist of Wet Reckless, First Offender (3/6/9 months), 18-Month (second offenders), and 30-month (three plus offenders). First offender participants are assigned based on blood alcohol content (BAC) levels. Existing law specifies the court procedures for treatment of certain drug offenders to PC 1000 programs instead of prosecution.

 

DUI programs are licensed by DHCS and regulated by Title 9 of the California Code of Regulations (CCR). Pursuant to Title 9, Section 9805, a county board of supervisors’ resolution or minute order recommending licensure, including a statement from the board indicating there is a demonstrated need for a new DUI program and the establishment of an additional program will not jeopardize the fiscal integrity of existing licensed DUI programs is required to accompany a DUI program license application to DHCS.

 

A&J is undergoing a change of ownership and is required by DHCS to relicense. The contractor has four (4) locations (Clovis, Kerman, Selma, and Reedley) within the County providing services to more than 900 participants in the last fiscal year. A&J is currently the only provider actively serving the needs of PC1000 participants.  Although PC1000 is not licensed by DHCS, the small census would make it financially untenable for A&J to continue serving this population without also serving the DUI program participants. The other contractors on Agreement 23-270 are Kings View servicing locations in Fresno and Clovis, while Fresno County Hispanic Commission service locations are in Fresno and Sanger with satellite programs in Coalinga and Firebaugh.

 

Approval of the recommended action will allow A&J to submit their application for relicensing with DHCS and continue to provide education, counseling, and diversion services to hundreds of County residents annually at no cost to the County of Fresno.
