SUBJECT: Award Contract 23-24-SW AADS Phase III Modules 9 and 10
RECOMMENDED ACTION(S):
TITLE
1. Adopt plans and specifications for Contract 23-24-SW American Avenue Disposal Site Phase III Modules 9 and 10 and award to the lowest bidder Yarbs Grading and Paving, Inc., 11339 S. Peach Avenue, Fresno CA, in the total amount of $7,357,089.
2. Authorize the Chairman to execute Contract Change Orders for Contract No. 23-24-SW in the amount of $290,000, in excess of the Director’s allowance of $210,000, up to a total change order limit of $500,000.
REPORT
Approval of the first recommended action will authorize the award of an American Avenue Disposal Site enterprise-funded landfill project. This item pertains to a location in District 1. The second recommended action would allow the Chairman to execute change orders up to 6.8% of the contract total.
ALTERNATIVE ACTION(S):
If the recommended action is not approved, the American Avenue Disposal Site (AADS) expansion will not be in compliance with Title 27 of the California Code of regulations and Title 40 of the Code of Federal Regulations and there will be no volume available in which to place refuse. AADS is the only regional landfill in Fresno County.
FISCAL IMPACT:
There is no Net County Cost associated with the recommended action. The anticipated construction cost for the project is $7,857,089, based on the low bid and the Director’s allowance for change orders of $210,000 and the Chairman’s allowance for change orders of $290,000. This proposed total change order limit of $500,000, or approximately 6.8%, is requested due to the scale and complexity of the project. Sufficient appropriations and estimated revenues are included in the FY 2023-24 Department of Public Works and Planning, American Avenue Disposal Site (AADS) - Org 9026 Program 91888 Adopted Budget.
DISCUSSION:
The AADS is the Fresno County Regional Municipal Disposal Facility operating under a Solid Waste Facilities Permit issued by the Department of Public Health with the concurrence of the California Department of Resources, Recycling and Recovery. The County has owned and operated the AADS since the early 1970s. The AADS is located on American Avenue, 17 miles southwest of the City of Fresno and 6 miles southwest of the City of Kerman. The site encompasses 440 acres, including 367 acres of permitted and available disposal area.
The work to be done consists, in general, of the excavation of Modules 9 and 10, installation of a composite liner system, and the performance of a geoelectric leak detection survey support. It also includes the sump liner system, riser pipes, pumps and control panels, clean out pipes, leachate and lysimeter meter runs, construction of Landfill customer access roads and side ditches as well as installation of erosion control items. Your Board made a finding pursuant to Public Contract Code 3400C to specify certain project components in the design on February 20, 2024.
A bid opening was held on February 8, 2024. Four bids were received. The low bid of $7,357,089, from Yarbs Grading and Paving, Inc., was $2,148,337 or 22.60% lower than the engineer’s estimate of $9,505,426. A list of bidders and their respective bid amounts is shown below:

Plans and Specifications were prepared by Department staff and are on file with the Department. It is anticipated that construction will commence in May 2024 and will be completed in September 2024.
California Environmental Quality Act (CEQA)
Department staff has determined that the AADS Phase III Modules 9 and 10 project is categorically exempt from the provisions of CEQA under Section 15301(b) - Existing Facilities.
