Recommended Action(s)
1. Make a finding that it is in the best interest of the County to waive the competitive bidding process consistent with Administrative Policy No. 34 for unusual or extraordinary circumstances for the solicitation of an authorized child passenger safety technician qualified as Lead Instructor meeting specified National Highway Traffic Safety Administration requirements for the Department of Public Health; and 2. Approve and authorize the Chairman to execute a retroactive Agreement with Kimberly Wilson, d.b.a. BabySafe of Fresno, to provide educational classes regarding child passenger safety restraint systems, effective July 1, 2018, not to exceed five consecutive years, which includes a three-year base contract and two optional one year extensions, total not to exceed $110,500.

RECOMMENDED ACTION(S):

TITLE

1.                     Make a finding that it is in the best interest of the County to waive the competitive bidding process consistent with Administrative Policy No. 34 for unusual or extraordinary circumstances for the solicitation of an authorized child passenger safety technician qualified as Lead Instructor meeting specified National Highway Traffic Safety Administration requirements for the Department of Public Health; and

 

2.                     Approve and authorize the Chairman to execute a retroactive Agreement with Kimberly Wilson, d.b.a. BabySafe of Fresno, to provide educational classes regarding child passenger safety restraint systems, effective July 1, 2018, not to exceed five consecutive years, which includes a three-year base contract and two optional one year extensions, total not to exceed $110,500.

REPORT

Approval of the recommended actions will allow the Department of Public Health to continue to utilize Kim Wilson, a Child Passenger Safety Lead Instructor certified by the National Highway Traffic Safety Administration (NHTSA), to provide educational classes to eligible community members and formal training to individuals seeking Child Passenger Safety Technician (CPST) certification. The services will be funded with through fines paid by violators of child car passenger safety codes, with no increase in Net County Cost. This item is countywide.

 

ALTERNATIVE ACTION(S):

 

Should your Board not approve the recommended actions, the Department would not be able to provide child passenger safety classes using a NHTSA-certified Lead Instructor.

 

SUSPENSION OF COMPETITION/SOLE SOURCE CONTRACT:

 

The Department requests to waive the competitive bidding process consistent with Administrative Policy No. 34 as Kim Wilson is the only vendor that provides child passenger safety community education classes and CPST training as a Lead Instructor meeting specified NHTSA requirements. The only other certified individual in the County to conduct child passenger safety inspections and presentations on an as-needed basis only is employed by the California Highway Patrol (CHP). Based on this, a letter of interest was not necessary.  The Internal Services Department - Purchasing Division concurs with the Department’s request to waive the competitive bidding process.

 

 

 

RETROACTIVE AGREEMENT:

 

The recommended agreement is retroactive to July 1, 2018. Contract negotiations and the time required to prepare and review the recommended agreement did not allow presentation to your Board at an earlier date.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended actions. The maximum compensation for the five-year term is $110,500; $22,100 annually. The recommended agreement will be funded through fines paid by violators of child car passenger safety codes. Sufficient appropriations and estimated revenues are included in the Department’s Org 5620 FY 2018-19 Recommended Budget and will be included in subsequent fiscal year budget requests.

 

DISCUSSION:

 

The Department’s Child RideSafe Program provides community education and assistance in the proper use of child passenger safety restraints. California Vehicle Code sections 15620, 27360, 27360.5 and 27362 are the funding authority that allows the collection of fines for the program. The Department has contracted with Kim Wilson, d.b.a. BabySafe of Fresno, since 1997 to conduct community classes on child passenger safety and formal training to individuals seeking CPST certification.  The most recent agreement was approved by the County Purchasing Manager on June 4, 2014 (P-14-297-L) and expired on June 30, 2018. BabySafe also offers income-eligible attendees an opportunity to purchase low-cost child passenger safety restraints supplied by the Department’s Child RideSafe program and funded through the fines.

 

Approval of the recommended actions would allow the Department to continue using a NHTSA-certified Lead Instructor to conduct community education classes and CPST courses. The only other certified individual in the County, a CHP employee, does not provide the community education model offered by BabySafe of Fresno. CHP interacts with individual community members by appointment only for required inspections, and only completes group presentations upon invitation from another hosting community organization. While both are designated Lead Instructors, Kim Wilson’s experience and service model make her uniquely qualified to provide essential services for the Child RideSafe Program.

 

With your Board’s approval, Kim Wilson, d.b.a. BabySafe of Fresno, will be able to continue providing educational child passenger safety restraint system classes to eligible community members and formal training to individuals seeking Child Passenger Safety Technician (CPST) certification.
