DISCUSSION:
The governing bodies of the above-listed public entities, except for the Fresno Local Agency Formation Commission/City of Fresno regarding the Ashlan-Hayes No. 2, 3, and 4, Reorganization Proposal, have called for elections on November 5, 2024, requesting that the Board of Supervisors order the consolidation of the elections with the Statewide General Election and stated on behalf of their entity that it will reimburse the County for costs incurred in conducting the entity’s election. California Elections Code section 10401 provides that when one of the elections to be consolidated is a statewide election, the Board of Supervisors may order the consolidation of the elections. Each entity will receive an invoice for its pro-rata share of the incurred elections costs in accordance with California Elections Code section 10002.
The Fresno Local Agency Formation Commission (“Commission”) adopted Resolution No. 246, dated June 12, 2024, to place the Ashlan-Hayes No. 2, 3, and 4 Reorganization Proposal ballot measure on the ballot at a special election conducted within the territory to be annexed, and directed the City of Fresno, as the project applicant, to assume all election incurred costs related to the ballot measure pursuant to California Government Code section 57150. The County Clerk/Registrar of Voters placed the Ashlan-Hayes No. 2, 3, and 4 Reorganization Proposal ballot measure on the ballot pursuant to California Government Code section 57000(e)(2) and authorizes its’ consolidation with the November 5, 2024, Statewide General Election.
