TO: Board of Supervisors
SUBMITTED BY: Steven E. White, Director
Department of Public Works and Planning
SUBJECT: Request by the City of Sanger to Obtain Right-of-Way in the County
RECOMMENDED ACTION(S):
TITLE
Approve request by the City of Sanger to acquire right-of-way, excluding eminent domain condemnation actions, from parcels adjacent to existing County right-of-way, within an identified unincorporated area, as needed to support construction and alignment of Indianola Avenue associated with Subdivision Tract 6493 between North Avenue and Edgar Avenue.
REPORT
There is no Net County Cost associated with the recommended action. Approval of the recommended action will authorize the acquisition of right-of-way (ROW) within the unincorporated area of Indianola Avenue between North Avenue and Edgar Avenue, as identified in Attachment A and shown in Attachment B. The City of Sanger (City) has been advised that your Board’s approval does not include authorization to undertake eminent domain proceedings. This item pertains to a location in District 4.
ALTERNATIVE ACTION(S):
If your Board does not approve the recommended action, the improvements required for Tract 6493 will not be able to proceed, including construction of the street, sidewalk, lighting, median, and landscaping along Indianola Avenue between North Avenue and Edgar Avenue.
FISCAL IMPACT:
There is no Net County Cost associated with the recommended action. Acquisition of the necessary ROW and construction of the street, sidewalk, lighting, median, and landscaping improvements will occur without fiscal impact to the County. All costs associated with ROW acquisition and construction of these improvements will be the responsibility of the City.
DISCUSSION:
The City is processing a new subdivision application, Tract 6493, located at the northeast corner of North Avenue and Indianola Avenue. As part of the subdivision’s conditions of approval, the developer must construct Indianola Avenue to the City’s collector standard and dedicate sufficient ROW for construction. Indianola Avenue currently exists as a two-lane County road south of North Avenue, and as a two-lane collector within the City in segments north of Annadale Avenue. Between Annadale and North Avenues, no public roadway exists; only 30 feet of ROW is present east of the quarter-section line, with none on the west side.
The subdivision improvement plans propose a divided roadway with northbound curb, gutter, sidewalk, lighting, landscaping, and southbound pavement with an asphalt dike, along with a landscaped raised median consistent with existing City improvements. Upon annexation of Tract 6493, the City limit line will shift to the quarter-section line at the roadway centerline. Because the westerly portion of the required ROW lies within County jurisdiction, the City requests County authorization to acquire and accept the new ROW needed for construction of Indianola Avenue.
Section 1810 of the Streets and Highways Code allows the Board of Supervisors to consent to the acquisition of a road easement by a city outside of its city limits when necessary to connect or widen the existing streets of the acquiring city. If your Board consents to the acquisition of ROW by the City, the acquired ROW becomes a city street for all purposes. The City will be responsible for the ongoing maintenance of the acquired ROW and associated improvements.
OTHER REVIEWING AGENCIES:
