SUBJECT: Amendments to Agreements with WestCare California, Inc. and Selma Community Outreach Ministries
RECOMMENDED ACTION(S):
TITLE
1. Approve and authorize the Chairman to execute First Amendment to Agreement No. A-24-247 with WestCare California, Inc. for rapid rehousing services with no change to the base term of July 1, 2024, through June 30, 2026, or compensation maximum of $3,436,263; and
2. Approve and authorize the Chairman to execute First Amendment to Agreement No. A-24-248 with Selma Community Outreach Ministries for rapid rehousing services with no change to the base term of July 1, 2024, through June 30, 2026, or compensation maximum of $1,495,579.
REPORT
There is no additional Net County Cost associated with the recommended actions. Approval of the recommended actions will revise language regarding participant eligibility. This item is countywide.
ALTERNATIVE ACTION(S):
Should your Board not approve the recommended actions, the agreements with WestCare California, Inc. (WestCare) and Selma Community Outreach Ministries (Selma COM) would not be updated to reflect current participant eligibility guidelines. This could lead to non-compliance with State mandates regarding participant eligibility for Rapid Rehousing Services that prioritize Housing First principles.
FISCAL IMPACT:
There is no increase in Net County Cost associated with the recommended actions. The services provided by WestCare and Selma COM under these agreements are funded by the State of California Homeless Housing, Assistance, and Prevention Program (HHAP). Sufficient appropriations and estimated revenues are included in the Department’s Org 5610 FY 2025-26 Adopted Budget.
DISCUSSION:
On May 21, 2024, following a Request for Proposal procurement process in which WestCare and Selma COM were selected to provide these services, the Board approved Agreement No. A-24-247 with WestCare and Agreement No. A-24-248 with Selma COM to provide Rapid Rehousing Services for the Fresno Madera Continuum of Care service area of Fresno and Madera counties. Both programs focus on helping individuals and families experiencing homelessness return to permanent housing as quickly as possible, providing immediate, temporary medium-term financial assistance, housing identification services, and case management.
The County has identified a need to revise specific language within the agreements concerning participant eligibility to ensure continued alignment with California Health and Safety Code (HSC) Section 50236. This amendment formally updates the "Scope of Services" section of the agreements by replacing the original "Exhibit C" with "Revised Exhibit C" and changes all references for "Exhibit C" to "Revised Exhibit C". These revisions include participant eligibility updates that ensure the agreements remain compliant with all relevant State mandates, specifically by removing language for a 30% Area Median Income (AMI) threshold needed for assistance, along with minor revisions to formatting. The 30% AMI threshold is not a requirement for HHAP funding, and this language was inadvertently included in the agreements. WestCare and Selma COM's services are part of a broader effort to reduce homelessness and are funded through the HHAP grant, with subrecipients required to comply with all State requirements governing the use of these funds.
