SUBJECT:                     Approve Conveyance of Right-of-Way to the City of Fresno

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize Chairman to execute Quitclaim Deed conveying a segment of Right-of-Way, on Lanes Road, west of Rice Road, to City of Fresno, ($0) [4/5 vote]

REPORT

The County-owned section of Lanes Road right-of-way, west of Rice Road, is within the city limits of Fresno and property owners, along with the City of Fresno (City) have requested the right-of-way be transferred to the City to simplify and streamline enforcement of trespassing and crime-related issues.  The road right-of-way will be conveyed to the City at no cost.

 

The recommended Board action approves this conveyance of approximately 4.03 acres of road right-of-way and authorizes the Chairman to execute the conveyance of the County road right-of-way to the City of Fresno via Quitclaim Deed (Attachment A).  This item pertains to a location in District 2.

 

ALTERNATIVE ACTION(S):

 

Your Board may determine not to approve the recommended conveyance of road right-of-way to the City.

 

FISCAL IMPACT:

 

There is no Net County Cost associated with this item.

 

DISCUSSION:

 

The County-owned section of Lanes Road right-of-way, west of Rice Road, is within the city limits of Fresno and property owners, along with the City, have requested the right-of-way be transferred to the City to simplify and streamline enforcement of trespassing and crime-related issues.  The road right-of-way will be conveyed to the City at no cost.

 

This segment of right-of-way will be conveyed at no cost to the City of Fresno pursuant to Government Code section 25365(a), which provides that the Board of Supervisors may, by a four-fifths vote, grant, convey, quitclaim, assign, or otherwise transfer to several certain types of public agencies, including a city, or exchange with those public agencies, any real or personal property, or interest therein belonging to the County, upon the terms and conditions as are agreed upon, and without complying with any other provisions of the Government Code, if the property or interest therein to be granted and conveyed or quitclaimed is not required for County use.

 

In accordance with the requirements of Government Code section 25365(c), staff has published a notice of this intended action one time, at least one week prior to this action, in a newspaper of general circulation published in the County.

 

The Quitclaim Deeds (Attachment A) for the County’s portion of the right-of-way have been prepared for your Board’s approval and execution by the Chairman.  Staff recommends approval of the conveyance of these portions of County right-of-way to the City of Fresno pursuant to Government Code section 25365(a).
