SUBJECT: Addenda and Article Deletions to the Memoranda of Understanding for Representation Units 3, 4, 12, 22 and 36
RECOMMENDED ACTION(S):
TITLE
1. Approve the Agency Shop and Objector Fee Addendum to the Memoranda of Understanding (MOUs) for Representation Units 3, 4, 12, 22 and 36, effective December 19, 2016.
2. Approve the Employee Grievance Resolution Procedure Addendum to the MOUs for Representation Units 3, 4, 12, 22 and 36, effective December 19, 2016.
3. Approve the deletion of the Meet and Confer Requirements Article in the MOUs for Representation Units 3, 4, 12, 22 and 36, effective December 19, 2016.
REPORT
Approval of the recommended actions would effectuate the tentatively agreed upon terms and conditions as delineated herein regarding the MOUs for Representation Units 3, 4, 12, 22 and 36, effective December 19, 2016.
ALTERNATIVE ACTION(S):
If the Board were not to approve recommended actions, then the existing terms and conditions of the current Agency Shop Articles, Employee Grievance Resolution Procedures and Forms, and Meet and Confer Articles for Representation Units 3, 4, 12, 22 and 36, would remain unchanged and in full force and effect.
FISCAL IMPACT:
The total estimated one-time start-up cost associated with Recommended Action No. 1, the negotiated terms and conditions of the Agency Shop and Objector Fee Addendum based on current Fresno County Master Schedule of Fees (MSF), shall not exceed $3,500, to be paid by Service Employee International Union - Local 521 (SEIU). The total annual cost of the negotiated terms and conditions of the Agency Shop and Objector Fee Addendum is approximately $550 (not to exceed $850) based on current MSF, to be paid by SEIU.
There are no costs associated with Recommended Actions No. 2 and 3.
DISCUSSION:
Pursuant to the Agency Shop Articles in the MOUs for Representation Units 3, 4, 12, 22 and 36, the County processes certain payroll deductions (Union Dues; Service Fees; and Religious Exemptions) from employees who are members of those representation units. SEIU, the exclusive representative for the aforementioned representation units, requested that the County process an additional payroll deduction for Objector Fees (i.e., chargeable expenses to cover costs germane to collective bargaining).
Your Board’s representatives have met and conferred with SEIU regarding the aforesaid matters. Tentative agreements were signed that would nullify the current Agency Shop Articles for each respective representation unit, and effectuate the Agency Shop and Objector Fee Addenda to include the additional payroll deductions for Objector Fees.
Pursuant to the Reopeners Articles in the respective MOUs, your Board’s representatives have met and conferred with SEIU regarding the Employee Grievance Resolution Procedures and Forms, as well as, the Meet and Confer Requirements Articles for those representation units. Tentative agreements were signed that would revise the Employee Grievance Resolution Procedures and Forms to provide a clearer and more comprehensive internal dispute resolution for employees, and would eliminate the Meet and Confer Requirements Articles due to obsolete and unnecessary language.
