DATE: November 3, 2026
TO: Board of Supervisors
SUBMITTED BY: Paul Nerland, County Administrative Officer
SUBJECT: Fourth Amendment to Joint Exercise of Powers Agreement
RECOMMENDED ACTION(S):
TITLE
Approve and authorize Chairman to execute Fourth Amendment to Agreement No. 80-258 to the Joint Exercise of Powers Agreement that established the Fresno-Madera Area Agency on Aging.
REPORT
There is no Net County Cost associated with the recommended action, which will authorize the Chairman to execute the fourth amendment to agreement No. 80-258, making the following updates: clarifies that the Fresno-Madera Area Agency on Aging (FMAAA) powers are exercised subject to the same restrictions imposed on the County of Fresno under California Government Code Section 6509, updates the alternative for each entity’s elected official member, and changes the voting requirement from a fixed minimum of eight (8) affirmative votes to a quorum vote.
ALTERNATIVE ACTION(S):
Should your Board not approve the recommended action, the fourth amendment to the Joint Exercise of the Powers Agreement (JPA) that established the FMAAA would not be executed, the governing board’s composition and voting powers would remain the same, and it would not be clear that FMAAA’s powers are exercised subject to the same restrictions imposed on the County of Fresno under California Government Code Section 6509.
FISCAL IMPACT:
There is no Net County Cost associated with the recommended action. Approval of the recommended action would make required updates to the JPA that established the FMAAA.
DISCUSSION:
The County of Fresno, along with the County of Madera and the City of Fresno are parties to a JPA that created the FMAAA to plan, coordinate, and deliver services to older adults in Planning and Service Area 14. The current agreement, agreement No. 80-258, was executed in 1980. Since then, FMAAA has been connecting older adults with information, resources, and services.
FMAAA’s goals include reducing hunger and increasing food security, supporting independent living, addressing basic needs and rights, and empowering clients to make informed decisions. In FY 2024-25, FMAAA served a total of 45,421 clients, which included 586,923 meals and 4,186 referrals to needed resources.
The recommended action approves the fourth amendment to the agreement, which:
• Clarifies that the FMAAA’s powers are exercised subject to the same restrictions imposed on the County of Fresno under California Government Code Section 6509,
• Updates the alternative for each entity’s elected official member; the alternate may now be either an elected member or a non-elected individual (previously required to be an elected member), and
• Changes the voting requirement from a fixed minimum of eight (8) affirmative votes to a quorum vote.
The County of Madera approved the fourth amendment on June 9, 2026. The City of Fresno approved the fourth amendment on August 27, 2026.
