SUBJECT:                     Second Amendment to Agreement with Clean Earth Environmental Solutions, Inc.

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute a Second Amendment to Agreement No. A-23-043 with Clean Earth Environmental Solutions, Inc. to revise the Household Hazardous Waste Operator’s Compensation to include additional waste streams collected at the Environmental Compliance Center (ECC), and authorizing the Director of Public Works and Planning to agree to pricing for future acceptable household hazardous waste items collected at the ECC, with no change to the term of February 1, 2023, through January 31, 2028, or compensation maximum of $7,500,000.

REPORT

Approval of the recommended action will allow Clean Earth Environmental Solutions, Inc. (Contractor) to provide household hazardous waste (HHW) collection of additional items; and will allow additional waste streams to be added to the Agreement by mutual consent by the Director of Public Works and Planning (Director) and the Contactor. This item is countywide.

 

ALTERNATIVE ACTION(S):

 

Your Board may deny the recommended action; however, this may result in an increase of illegal dumping of HHW.

 

FISCAL IMPACT:

 

There is no Net County Cost associated with the recommended action. Operation of the ECC and associated Local Network Programs, such as the sharps, bulbs and battery drop-off locations and Temporary HHW Collection Events throughout Fresno County and its jurisdictions, are fully funded by accumulated and current surcharge revenues on each ton of landfilled solid waste generated in Fresno County. Sufficient appropriations have been included in the FY 2025-26 Recommended Budget for the Public Works and Planning Resources Org 9015 and will be included in subsequent budget requests.

 

DISCUSSION:

 

On January 24, 2023, the County entered into Agreement A-23-043 with the Contractor to provide HHW Program Operations Services for a term of three years, with the option of two one-year extensions. The Contractor serves as the County’s Regional HHW Facility Manager, implements various HHW-related programs, provides staffing, oversees the day-to-day operations/maintenance of one or more HHW facilities, meets Federal, State, and County reporting protocols, and ensures proper storage, transport, disposal, and recycling of collected materials. In addition to providing for operations at the ECC, the Contractor provides staffing and operations for the HHW Local Network, Door-to-Door and Temporary One-Day Collection Events.

On October 24, 2023, the Board approved the first amendment which provided HHW collection and transportation services at local HHW network temporary events.

 

The second amendment will add the additional waste streams identified in Exhibit B-2025, and their corresponding reimbursement prices, to the existing agreement, without any change in the term or maximum contract value. The Amendment will also authorize the Director to add additional acceptable waste streams, with their corresponding reimbursement prices, in the event that unusual items not identified in the Agreement need to be collected and disposed of at the ECC.
