SUBJECT: Delegate Authority to Execute a Cooperative Agreement with the City of Clovis for the Gettysburg Avenue Street Improvements, Sierra Vista Parkway to Clovis Avenue Project
RECOMMENDED ACTION(S):
TITLE
Authorize the Director of Public Works and Planning, or his/her designee, to execute a Cooperative Agreement with the City of Clovis to pay the County’s share of costs for Design and Construction of the Gettysburg Avenue Street Improvements Project, and to authorize cost changes up to 20% of the County’s share of cost, which would be substantially similar to the form attached to this item, subject to the review and approval of County Counsel as to legal form and the Auditor-Controller/Treasurer-Tax Collector as to accounting form. ($178,881 maximum)
REPORT
Approval of the recommended action would authorize the Director of Public Works and Planning, or his/her designee, to execute an Agreement with the City of Clovis to pay for the County’s share of cost for design and construction costs related to the Gettysburg Avenue Street Improvements between Clovis Avenue and Sierra Vista Avenue Project (Project), Federal Aid Number STBG-5208(184), and to approve cost changes up to 20% of the County’s total share of cost in accordance with the Agreement terms, for a maximum of $178,881. This item pertains to a location in District 5.
ALTERNATIVE ACTION(S):
If the recommended action is not approved, the Project may suffer delays before or during construction.
FISCAL IMPACT:
There is no increase in Net County Cost associated with the recommended action. Sufficient appropriations and estimated revenues are included in the Department’s Road Org 4510 FY 2024-25 Adopted Budget.
DISCUSSION:
The recommended Agreement with the City of Clovis is for the design and construction of street improvements along Gettysburg Avenue, between Clovis and Sierra Vista Avenues, along a shared jurisdictional corridor. The project is federally funded through the Surface Transportation Block Grant (STBG) program, up to a $1.03 million/88.53% Federal share. Approximately 23.5% of the project lies within the County’s jurisdiction, and the recommended Agreement provides that the County will pay for that share of remaining local match. The Agreement estimates the County’s share of cost for the project at $350,847 and the County’s local match to be $108,712 but allows for changes up to 20% over those estimated costs. It’s expected that the STBG share will be entirely expended by planned costs, and that any additional costs would be entirely borne by the City and County, for a maximum value (without amendment) of up to $178,881.
The final Agreement that will be signed by the Director will be substantively similar to the draft version attached hereto, subject to the review and approval as to form by County Counsel, and as to accounting form by the Auditor-Controller/Treasurer-Tax Collector. The work will not begin until the Agreement is fully executed. Authorizing the Director to sign the Agreement will ensure that there are no delays in construction of this project.
The recommended Agreement also provides that the County may inspect the construction work under our own initiative and cost and contains mutual indemnification provisions which are common in Agreements between public agencies.
