SUBJECT:                     Second Amendment to Agreement with Turning Point of Central California, Inc.

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute Second Amendment to Agreement No. 19-039 with Turning Point of Central California, Inc., for transitional housing beds, sustenance, and associated services, with no change in term to January 31, 2024 and increasing the maximum by $1,972,460 to a total of $7,972,460.

REPORT

There is no Net County Cost associated with the recommended action, as increased costs for this second amendment are fully offset with Edward Byrne Memorial Justice Assistance Grant (JAG) revenue. The recommended amendment will increase the maximum number of beds allowed under this agreement from 50 to 70 daily occupied beds, at a daily rate of $67.55.  This is the same rate as provided in the current agreement for 40 to 50 occupied beds. This item is countywide.

 

ALTERNATIVE ACTION(S):

 

If the recommended action is not approved, the annual maximum compensation will remain at $1,200,000, and the total maximum compensation will remain at $6,000,000. This would result in no additional beds being added to address the transitional housing needs identified in the JAG. 

 

FISCAL IMPACT:

 

There is no Net County Cost associated with the recommended action. Funding for this amendment is fully offset with Edward Byrne Memorial Justice Assistance Grant.  The maximum annual compensation for this agreement with approval of the recommended  amendment is $1,693,115, with a maximum compensation for the full 5-year term totaling $7,972,460. There are adequate appropriations and estimated revenues included in Probation’s FY 2019-20 Grant Org 3432 Budget. Funding for subsequent years of this Agreement will be included in the Department’s future budget requests.

 

DISCUSSION:

 

On November 20, 2018, the County issued a Request for Quotations (RFQ) to solicit proposals from qualified vendors to provide transitional housing, sustenance, support services/resources, programming, and other similar services provided in a safe, clean, drug-free environment for up to 50 participants, both male and female adults on probation or in the Probation Department’s Pre-Trial Program. Turning Point of Central  California, Inc., the County’s current vendor at that time for these services, responded to the RFQ, and represented it could provide these services at a compensation rate based on occupancy tier levels matching lowest number of occupants to the highest cost.  On January 29, 2019 your Board approved the Agreement A-19-039 with Turning Point, which provided for $600,000 annual compensation, and a term maximum compensation of $3,000,000 for transitional housing services. 

 

On May 7, 2019, your Board approved the First Amendment to this Agreement, in conjunction with the Community Corrections Partnership’s (CCP) increase in the allocation of Assembly Bill 109 funding to $1,200,000 annually, increasing the total Agreement maximum to $6,000,000. This allowed for an increase in the average number of occupied beds in the program from 5 to approximately 49.  This also provided the most cost-effective rate of $67.55 per bed per day. Prior to this action, the department’s funding level of $600,000 per year would have maintained approximately 5 occupied beds at the rate of $363.06 per bed per day based on the rate received during the November 2018 RFQ process.  As the number of occupied beds per day increases for each factor of 10, the rate tier decreases.

 

On November 19, 2019, your Board approved and authorized the execution of the retroactive Grant Application/Agreement with the Board of State and Community Corrections for the Edward Byrne Justice Assistance Grant for the period of October 1, 2019 to December 31, 2022, in the amount of $3,136,875. The JAG Program’s purpose is to develop re-entry case management and supportive services for individuals, male or female, 18-30 years of age, affiliated or previously affiliated with a gang, who are incarcerated in the Fresno County Jail for at least 60 days and have a medium to high risk to offend. The goal of the JAG Program is to reduce gang activity after release from custody, and increase public safety.

 

The recommended amendment will help to meet the goal of the JAG Program by addressing one of the identified primary criminogenic needs, transitional housing. The JAG budget included funding for transitional housing services for ten occupied beds per day on an annual basis.  If there are savings in grants funds from other line items, a budget modification can be requested to increase the transitional housing beds, if needed, by an additional ten beds.   Based on this, the recommended amendment increases the number of beds provided in this agreement from 50 to 70 beds.  The agreement has a tiered pricing structure based on occupied beds.  The per bed per day tier level for 1 to 10 occupied beds is $363.06 and reduces as more beds are occupied to $67.55 per bed for 40-50 occupied beds.  The additional beds being added as part of the recommended amendment will be at the $67.55 rate per bed per day. The AB109 program currently averages an occupancy of 40 to 50 beds per day and there is a waiting list, so the additional beds will be utilized.
