SUBJECT: Award Contract 25-04-PR Kearney Park Improvements
RECOMMENDED ACTION(S):
TITLE
1. Adopt plans and specifications for Contract 25-04-PR Kearney Park Improvements and award to the lowest bidder Harris Development Corp dba HBC Enterprises, 2743 E. Shaw Avenue, Suite 105-08 Clovis, CA 93611, in the total amount of $2,499,829.80 for the base bid and Additive Bid 1; and
2. Authorize the Director to execute contract change orders for Contract 25-04-PR Kearney Park Improvements, not to exceed $137,491 for any one change order pursuant to Public Contract Code 20142, and not to exceed a total change order limit of $550,360 or 22% of the total compensation payable under Contract 25-04-PR.
REPORT
Approval of the first recommended action will result in your Board’s adoption of plans and specification for an American Rescue Plan Act - State and Local Fiscal Recovery Funds (ARPA-SLFRF) funded project which will make improvements at Kearney Park.
Approval of the second recommended action will authorize the Director to execute contract change orders not to exceed $137,491 for any one change order, and not to exceed a total change order limit of $550,360 or 22% of the total payable compensation under the recommended contract. This item pertains to a location in District 1.
ALTERNATIVE ACTION(S):
If the recommended actions are not approved, the project will be delayed or will not be constructed. Alternatively, your Board may determine to approve this item without delegating the authority to the Director to execute change orders, in this event if any change orders are needed, the construction could be delayed due to the time required to return to your Board to request approvals of individual change orders.
FISCAL IMPACT:
There is no Net County Cost associated with the recommended actions. This project will be funded by ARPA-SLFRF which provides a total of $4,485,275 for improvements to Kearney Park. The anticipated construction cost for this contract is $3,050,191, based on the low bid and Director’s change order limit of $550,360, totaling approximately 22% of the contract in change orders. While there are insufficient funds remaining in the grant to completely repair the decorative rock walls throughout the park and award Additive Bid 2 for the bid amount of $557,681, some segments of the decorative rock wall repairs may be added to the work via change order, along with other changes orders as needed throughout construction.
The overall cost of this project, including this construction contract, are estimated to total $4,485,275. In addition to the construction costs of $3,050,191 for this contract, several components of the work have been procured separately, including a prefabricated restroom, a premanufactured steel shelter, playground structures, and playground tiles totaling $850,085. Department staff time, consultant costs for design, and construction management is estimated to cost approximately $550,000 and other repairs, such as well pump repairs, cost $55,000. Sufficient appropriations and estimated revenues are included in the Department of Public Works and Planning - Org 8870 FY 2025-26 Proposed Budget.
DISCUSSION:
Kearney Park is the largest County park consisting of 225 acres located two miles west of the City of Fresno, near the intersection of W. Kearney Boulevard and S. Grantland Avenue, at 6725 W. Kearney Boulevard in Fresno, CA 93706. This historic and popular park has open green space for recreational activities, large group picnic areas, and hosts community events and festivals throughout the year. Kearney Park is also home to the historical Kearney Mansion Museum, disc golf courses, and softball fields.
On November 29, 2022, and April 25, 2023, the Board approved funding from ARPA-SLFRF to be administered by the Public Works and Planning Department for infrastructure improvements to facilities, water and sewer systems, and numerous County parks, including Kearney Park.
On November 5, 2024, your Board approved a retroactive interdepartmental agreement with the Department which obligated ARPA-SLFRF funding for twelve programs to be implemented by the Department. Improvements to Kearney Park is described in Exhibit E of the executed interdepartmental agreement with the department.
The work to be done consists, in general, of improvements to Kearney Park including the installation of a new County-furnished prefabricated restroom and connecting it to utilities, demolishing two septic tanks at existing restrooms and connecting those restrooms to an existing City of Fresno sewer trunk, removing and disposing of one outdated playground and installing three new County-furnished playground structures, installing a County-furnished premanufactured steel shelter, constructing a multi-purpose court, which would include tennis, basketball and pickleball courts, reconstructing a parking lot, installing additional lighting throughout the park, and other miscellaneous work such as clearing and grubbing, grading, parking lot striping, installation of speed bumps and wheel stops. The work to be done also includes additive items, such as fog sealing some of the existing parking lots and the replacement and/or repair of existing decorative rock walls throughout the park.
The project was advertised on June 3, 2025, and a bid opening was held on July 2, 2025. Six bids were received. The low bid of $3,057,510.40, from Harris Development Corp dba HBC Enterprises, was $95,877 or 3.24% higher than the engineer’s estimate of $2,961,633. The lowest bid consisted of $2,488,530 for the base bid, $11,300 for Additive 1 (Fog Seal), and $557,681 for Additive 2 (Rock Wall Replacement/Repair). Plans and Specifications were prepared by Department staff with electrical sections prepared by the consultant engineer, Borrelli & Associates, Inc., and are on file with the Department. It is anticipated that construction will commence in September 2025 and will be completed in early 2026.
California Environmental Quality Act
The proposed Kearney Park Improvements is categorically exempt from the provisions of California Environmental Quality Act under Section 15301 - Existing Facilities and Section 15311 - Accessory Structures. A Notice of Exemption was filed with the Office of the Fresno County Clerk on November 2, 2023.
