SUBJECT: Contract No. 16-01-C, Dunlap Elementary Crosswalk Lights and Sidewalk: Cooperative Agreement with Kings Canyon Unified School District ($129,116) and Advertise Contract for Construction
RECOMMENDED ACTION(S):
TITLE
1. Approve and authorize the Chairman to execute cooperative agreement with the Kings Canyon Unified School District for the construction of the Dunlap Elementary Crosswalk Lights and Sidewalk Project ($129,116).
2. Adopt plans and specifications for Contract No. 16-01-C, Dunlap Elementary Crosswalk Lights and Sidewalk, and authorize the Director of the Department of Public Works and Planning, or his designee, to advertise for bids and set bid opening date contingent upon the Department receiving authorization from the California Department of Transportation.
REPORT
Approval of the first recommended action will authorize the execution of a cooperative agreement pursuant to which the Kings Canyon Unified School District (District) will pay costs associated with the construction of a sidewalk on school property. Approval of the second recommended action will authorize the advertisement of a federally funded Active Transportation Program (ATP) project.
ALTERNATIVE ACTION(S):
If the first recommended action is not approved, the school district will not be able to contribute to the payment of costs associated with the project and the cost of the work on school property would have to be paid from the County’s Road Fund. Not approving the second recommended action will result in cancellation of the project and de-obligation of the allocated federal funding. Any funds received by the County for this project to date would require reimbursement to the Federal Highway Administration from the Road Fund.
FISCAL IMPACT:
There is no Net County Cost associated with the recommended actions. The ATP will provide $32,000 for preliminary engineering and up to $130,000 for contract construction and construction inspection. Costs associated with the construction of the sidewalk on school property will be paid by the District. Costs associated with the portion of the project within the County right-of-way in excess of the ATP funding will be paid out of the Road Fund and are included in the FY 2016-17 Public Works and Planning - Roads Org 4510 Adopted Budget. The contract construction cost is anticipated to range between $152,000 and $168,000.
DISCUSSION:
The purpose of the ATP is to encourage increased use of active modes of transportation, such as biking and walking, while improving safety. The work to be done consists, in general, of installing an in-pavement lighting system at the existing crosswalk on Dunlap Road between Dunlap Elementary School and the Dunlap Leadership Academy, installing advance crosswalk warning signs at the blind curves to the east and west of the crosswalk, installing an asphalt concrete walkway to connect the existing sidewalk at the elementary school to the crosswalk, and installing a new ADA compliant concrete sidewalk along the north side of the Leadership Academy’s existing paved driveway from Dunlap Road to the existing concrete sidewalk at the top of the driveway.
Projected project costs exceed the funding allocation and the District has agreed to participate in funding the portion of the project that is on school property outside the County’s right-of-way. Pursuant to the agreement, the District will pay all of the costs associated with contract construction on school property and will also pay a proportionate share of the costs of preliminary engineering and construction engineering, with a maximum total contribution by the District of $129,116. The agreement term is three years, with the option to extend the agreement by up to two years if necessary. The agreement includes mutual indemnification clauses.
Prior to advertising, the Federal Highway Administration requires authorization to advertise from the California Department of Transportation (Caltrans). Advertising will not commence until this authorization is received. Plans and Specifications were prepared by the Department’s Design Division. It is anticipated that construction for the project will begin in June of 2017 and be completed in August of 2017.
OTHER REVIEWING AGENCIES:
Caltrans provides oversight on projects where federal funds are allocated. The agreement was approved by the District on February 7, 2017.
