SUBMITTED BY: Steven E. White, Director
Department of Public Works and Planning
SUBJECT: Amendment II to Agreement with the City of Fowler (CDBG 19231)
RECOMMENDED ACTION(S):
TITLE
Approve and authorize the Chairman to execute Amendment II to Agreement No. 20-042 with the City of Fowler for the Fowler Panzak Park ADA Restroom, Community Development Block Grant Project No. 19231, effective upon execution with no change in the term to September 30, 2021, and increasing the maximum Community Development Block Grant funding by $108,591 to a total Community Development Block Grant funding amount not to exceed $272,649.
REPORT
Approval of the recommended action will provide an additional $108,591 in Community Development Block Grant (CDBG) funds to the Fowler Panzak Park ADA Restroom Project (Project), increasing the CDBG funds from $164,058 to $272,649. The additional funds are needed to reduce local fund contribution and are available from the City of Fowler’s (City) CDBG allocation included in the County’s 2021-22 Action Plan, approved by your Board on May 11, 2021. The total Project cost is estimated at $304,240. The City will contribute the remaining $31,591 towards the Project. This item pertains to a location in District 1.
ALTERNATIVE ACTION(S):
Your Board may choose not to approve the recommended second amendment, which may result in the City not having sufficient funds to complete the Project.
FISCAL IMPACT:
There is no Net County Cost associated with the recommended action. The recommended second amendment will increase CDBG funding by $108,591; from $164,058 to $272,649. The additional CDBG funds are included in the Department of Public Works and Planning - Community Development Block Grant Org 7205 FY 2021-22 Recommended Budget and represent the City’s 2021-22 CDBG allocation. CDBG funds are provided on a reimbursement basis. If the recommended action is approved, the City’s local financial contribution in excess of the CDBG funds, which may be necessary to complete the Project, will decrease from $140,182 to $31,591.
DISCUSSION:
On January 21, 2020, the Board approved the Project. The agreement provided CDBG funds ($116,444) to the City, on a reimbursement basis, for the replacement of the existing park restroom with a prefabricated restroom and appurtenant facilities meeting Americans with Disabilities (ADA) standards. The Project is located at Panzak Park, on the north side of Merced Street between 2nd and 3rd Streets in the City.
On August 4, 2020, the Board approved Amendment I, providing additional CDBG funds to the Project to reduce local fund contribution. The recommended second amendment will further increase the total CDBG funds allocated to the Project, from $164,058 to $272,649, and will reduce local fund contribution to complete the Project from $140,182 to $31,591. All remaining provisions of the agreement, as previously amended, will remain in full force and effect.
