SUBJECT: Amendment I to Agreement with City of Kerman for the Kerman Plaza Veterans Park Project (CDBG 23371)
RECOMMENDED ACTION(S):
TITLE
1. Amend FY 2025-26 Action Plan to increase funding for the Kerman Plaza Veterans Park and reduce funding for the Kerman Kerckhoff Park Improvements projects; and
2. Approve and authorize the Chairman to execute Amendment I to Agreement No. 25-013 with City of Kerman for the Kerman Plaza Veterans Park Project, Community Development Block Grant (CDBG) Project No. 23371, effective upon execution with no change in term through September 23, 2026, increasing the maximum CDBG funds provided by $73,982, and reducing the City of Kerman’s local financial contribution, to a total CDBG funding amount not to exceed $249,300.
REPORT
There is no Net County Cost associated with the recommended actions. Approval of the recommended actions will provide additional Community Development Block Grant (CDBG) funding for the Kerman Plaza Veterans Park (Project). Neither recommended action is viable individually; both actions should be either approved or denied together. These additional funds are available from the City of Kerman (City) CDBG allocation included in the County’s 2025-2026 Action Plan, as approved by your Board on August 5, 2025, and amended on March 17, 2026. The total Project cost is estimated at $249,300. The recommended amendment will increase CDBG funding for the Project by $73,982, from $175,318 to $249,300, due to increased construction costs and to decrease the City’s local financial contribution from $11,882 to $0. This item pertains to a location in District 1.
ALTERNATIVE ACTION(S):
Your Board may choose not to approve the recommended actions, requiring the City to provide local financial contributions to cover Project costs that exceed the current $175,318 in CDBG funding provided in the agreement, and direct the City to propose a different eligible use for its 2025-2026 CDBG funds. However, a different use would require an amendment to the 2025-2026 Annual Action Plan and may impact the County’s ability to meet its CDBG expenditure timelines, set by the U.S. Department of Housing and Urban Development (HUD).
FISCAL IMPACT:
There is no Net County Cost associated with the recommended actions. The recommended amendment will increase CDBG funding for the Project by $73,982, from $175,318 to $249,300, due to increased construction costs and to decrease the City’s local financial contribution. The total Project cost is estimated at $249,300. The additional CDBG funds are included in the Department of Public Works and Planning - Community Development Block Grant Org 7205 FY 2025-26 Adopted Budget. CDBG funds are provided on a reimbursement basis.
DISCUSSION:
On May 9, 2023, the Board approved the FY 2023-24 Action Plan, which included funding for the Project. On January 7, 2025, your Board approved Agreement No. 25-013 (Agreement) for the Project, providing $175,318 in CDBG funds to the City, on a reimbursement basis. The Project consists of the demolition and removal of an existing non-functional restroom at the existing Kerman Plaza Veterans Park, and the installation of a prefabricated Americans with Disabilities Act (ADA) accessible restroom and necessary concrete flatwork. Existing utility services and connections may be replaced or modified, as needed, to accommodate the new restroom. The Project is located at Plaza Veterans Park, an existing park space in Kerman in the median of Madera Avenue, just south of “B” Street.
On August 5, 2025, your Board approved the FY 2025-26 Action Plan, which included additional $15,000 in funding for the Project, and $280,039 in funding for the Kerman Kerckhoff Park project. Due to increased costs for the Project, the City has requested to increase the 2025-26 CDBG funding allocated for the Project from $15,000 to $73,982, and to reduce the funding for the Kerckhoff Park project, from $280,039 to $221,057, with no change to the City’s combined funding amount. If approved, the first recommended action will amend the FY2025-26 Action Plan funding allocation for these two projects per the City’s request.
If approved, the second recommended action will increase the total CDBG funds allocated to this Project from $175,318 to $249,300. All remaining provisions of the Agreement will remain in full force and effect.
Pursuant to the authority previously delegated to him under Section VII of the Agreement, the Director of the Department approved an extension to the completion date of the Project, in recognition of Project barriers outside of the City’s control, to September 23, 2026. The City does not anticipate any additional extensions will be necessary.
