SUBJECT: Agreement with BlueDAG, LLC
RECOMMENDED ACTION(S):
TITLE
1. Under Administrative Policy No. 34 for competitive bids or requests for proposals (AP 34), determine that an exception to the competitive bidding requirement under AP 34 is satisfied and a suspension of competition is warranted due to unusual or extraordinary circumstances, and that the best interests of the County would be served by entering into an Agreement with BlueDAG, LLC, as they are the only company that can provide software for both Americans with Disabilities Act building evaluation and compliance planning into one widely accessible software solution; and
2. Approve and authorize the Chairman to execute an Agreement with BlueDAG, LLC for Americans with Disabilities Act surveying software, effective July 1, 2025, not to exceed five consecutive years, which includes a three-year base contract and two optional one-year extensions, total not to exceed $471,489.
REPORT
There is no additional Net County Cost associated with the recommended actions, which will provide the Department of Public Works and Planning (Public Works) and the General Services Department - Facility Services Division (GSD - Facilities) with continued access to BlueDAG, LLC (BlueDAG) software for Americans with Disabilities Act (ADA) building evaluation and compliance planning. This item is countywide.
ALTERNATIVE ACTION(S):
Should your Board not approve the recommended actions, the County would not have a viable method to ensure that County properties remain in compliance with ADA regulations and would have no means to generate comprehensive plans to address any potential existing access issues.
SUSPENSION OF COMPETITION/SOLE SOURCE CONTRACT:
It is requested that the County find under AP 34 that an exception to the competitive bidding requirement is satisfied, and a suspension of competition is warranted, due to unusual or extraordinary circumstances as BlueDAG is the only vendor that can provide one software solution that addresses the need for both ADA building evaluations and compliance planning. There are software solutions that assist with facility asset management and provide ADA website compliance reports separately. One vendor, Agreeya, can offer both solutions into one database, but the software can only be accessed via a mobile device, which does not meet the County’s needs. BlueDAG offers software that combines both into one database and is the most accessible to the County. The General Services Department - Purchasing Division concurs with the Department’s assessment that this satisfies the exception to the competitive bidding process under AP 34.
FISCAL IMPACT:
There is no increase in Net County Cost associated with the recommended actions. Sufficient appropriations and estimated revenues are included in the General Services Department’s Org 8935 FY 2025-26 Recommended Budget and will be included in future budget requests for the duration of the recommended Agreement. All costs associated with the recommended Agreement will be recovered through charge backs to user departments.
DISCUSSION:
In 2019, the County, led by staff from both Public Works and the Internal Services Department - Facility Services Division, began the development of a comprehensive evaluation of all County-owned, leased, or operated facilities as well as roads and rights-of-way. On July 9, 2019, the Board approved an agreement with BlueDAG for ADA building evaluation and compliance management software to assist staff with the evaluation and ensure ADA compliance in County-owned buildings. This agreement expired on July 8, 2024. A Purchase Order was utilized as an interim solution to continue services while staff worked to bring the recommended Agreement before your Board for consideration.
BlueDAG software is a tool used by County staff to perform evaluations of buildings, roads, sidewalks, and other facilities. The software integrates the evaluations into a comprehensive plan to address any ADA Title II compliance issues identified. Under Title II of the ADA, the County is prohibited from denying the benefits of its programs, services, and activities to individuals with disabilities due to the presence of inaccessible facilities. The BlueDAG field survey tool is used by surveyors while completing field surveys, and the completed data is downloaded into BlueDAG’s master database upon completion of each assessment. All collected data is securely stored in cloud-based storage provided by BlueDAG to ensure its protection.
BlueDAG offers the only tool that integrates Global Positioning System data, provides an effective pre-generated survey for a variety of buildings and facilities, and allows for the generation and administration of an ADA Title II management plan.
The recommended Agreement allows the County to continue to use BlueDAG software with a three-year term with two optional one-year extension, total not to exceed $471,489.
