SUBJECT:                     Second Amendment to Agreement No. A-24-085 with California Health and Human Services, Office of Youth and Community Restoration for Transition to Less Restrictive Programs Grant

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute Second Amendment to Agreement No. A-24-085 with the California Health and Human Services, Office of Youth and Community Restoration for the Less Restrictive Programs Grant (Grant No. 2023-349-OYCR), to extend the term from January 1, 2028, to July 31, 2028, with no change to the compensation maximum ($2,000,000).

REPORT

There is no additional Net County Cost associated with the recommended action. The Office of Youth and Community Restoration (OYCR) Less Restrictive Programs (LRP) Grant funding allows for development and support of LRPs, pursuant to Welfare & Institutions Code section 875(f)(1). The recommended action will extend the term of the existing grant agreement with OYCR, as previously amended, by seven months. This item is countywide.

 

ALTERNATIVE ACTION(S):

 

If the recommended action is not approved, the amendment will be returned to OYCR unexecuted, and the County will forfeit any grant funding not utilized by December 31, 2027. The loss of these grant funds will result in the County being financially responsible for developing and supporting youth transitioning to less restrictive programs, as required by Welfare & Institutions Code section 875(f)(1), without additional financial assistance.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended action. The maximum compensation of $2,000,000 for the grant agreement is unchanged. This grant will support the transition of 10 youth from the Secure Youth Treatment Facility (SYTF) at the Juvenile Justice Campus (JJC) to LRP settings and community living status for the period of December 15, 2023, through July 31, 2028. Sufficient appropriations and estimated revenues are in the Department’s Org 3432 FY 2025-26 Adopted Budget and will be included in future budget requests.

 

DISCUSSION:

 

On May 14, 2021, Senate Bill 92 Juvenile Justice was signed into law and took effect on July 1, 2021. This legislation allowed for the creation of SYTFs, providing courts with the ability to commit youth to less restrictive programs aimed at facilitating their safe and successful reintegration into the community, as outlined in Welfare & Institutions Code section 875(f)(1).

 

On February 20, 2024, the Board retroactively approved the grant application submission and grant agreement with OYCR for funding to support 10 youth in transitioning these youth to a less restrictive environment. The goal is to achieve step-down transitions to LRPs and provide services that support successful community living. Awarded funds must be used to support partnerships with community-based service providers that will help individual youth transition through less restrictive programs and settings. These funds also directly assist the youth in meeting their needs after transitioning to home or community living, while still completing their commitment term. LRPs can include halfway houses, camps or ranches, or community residential or non-residential programs, including home-based or educational-based placements. Youth are placed in LRPs as part of their commitment time.

 

On March 25, 2025, the Board approved the first amendment to extend the term of the grant agreement by two years, from a grant termination date of December 31, 2025, to December 31, 2027, and update the points of contact for OYCR. The extension allowed the Department to implement several targeted focus areas to ensure the funds are used in alignment with programmatic needs. This included developing internal protocols for flexible funding supports, which enabled purchases such as laptops for SYTF youth to continue their higher-education goals upon release into the community. On May 20, 2025, the Board approved Agreement No. A-25-196 with Tek84 Inc. for the purchase of body scanners to enhance screening and address contraband-related safety concerns for youth preparing for LRP through the resumption of furloughs. Additionally, the County completed the competitive bid process to identify a vendor to provide community-based, least-restrictive programming services required by the grant. The resulting vendor agreement with Focus Forward is being brought before your Board for approval.

 

Approval of the recommended action will further extend the term of the grant agreement to July 31, 2028. The extension will allow County to fully fund a community-based, least-restrictive programming agreement, consisting of a two-year base contract and an optional six-month extension, with this existing grant funding.
