SUBJECT: BSCC JAG Certification Regarding Lobbying
RECOMMENDED ACTION(S):
TITLE
Approve and authorize the Chairman to execute the Certification Regarding Lobbying, and all other required assurances or certifications required to maintain the agreement with the Board of State Community Corrections for the Edward Byrne Memorial Justice Assistance Grant, for the period of June 1, 2023 to September 30, 2027, subject to approval as to legal form by County Counsel and to accounting form by the Auditor-Controller/Treasurer-Tax Collector.
REPORT
There is no additional Net County Cost associated with the recommended action, which will allow for execution of Certification Regarding Lobbying as required by the Board of State and Community Corrections (BSCC). The grant agreement was approved by the Board on July 18, 2023 for the BSCC Edward Byrne Memorial Justice Assistance Grant (JAG). In August of 2026, BSCC notified the Probation Department that a Certification Regarding Lobbying is required to be completed to ensure compliance with federal regulations per the United States Department of Justice (DOJ). This item is countywide.
ALTERNATIVE ACTION(S):
If the recommended action is not approved, the County may lose JAG grant funding.
FISCAL IMPACT:
There is no increase in Net County Cost associated with the recommended action. Sufficient appropriations and revenues are included in the FY 2026-27 Probation Grants Org 3432 Adopted Budget for the JAG program.
DISCUSSION:
On July 18, 2023, the Board approved and authorized the Chairman to execute the retroactive Grant Application/Agreement No. 23-372 with BSCC for the competitive funding award of the JAG funding for the Fresno County Probation Department. The Board also adopted a resolution authorizing the Chairman to execute the retroactive grant Agreement and any extensions or amendments thereto, subject to approval as to legal form by County Counsel and to accounting form by the Auditor-Controller/Treasurer-Tax Collector. The executed agreement was originally effective June 1, 2023 to December 31, 2026, in the amount of $2,837,831. BSCC offered a no-cost nine-month extension through September 30, 2027, which was approved by the Chairman on June 1, 2026, and was fully executed by BSCC on July 2, 2026.
The Department utilizes the JAG funding for the Adult Reentry Planning Program (ARPP). The purpose of ARPP is to develop reentry case management and supportive services for individuals who are incarcerated in the Fresno County Jail for at least sixty days, male or female, 18-40 years of age, with current or previous gang affiliation, and with a medium to high risk to reoffend. The goal of the ARPP is to facilitate successful reentry into the community, reduce gang activity after release from custody, reduce recidivism, and increase public safety.
On August 11, 2026, BSCC advised that they recently received a routine monitoring visit for JAG from the US DOJ Bureau of Justice Assistance (BJA). During the visit, BSCC was advised that, per federal regulation, all Prime and Sub-Recipients of Residential Substance Abuse Treatment (RSAT) Program funds must complete the Certification Regarding Lobbying to certify that no JAG funding will be used for lobbying purposes. The recommended action will authorize the Chairman to execute the required Certification, as well as all other required assurances or certifications through the remainder of the grant period.
