SUBJECT: Resolution to Authorize Signatory of Documents Related to the Operation of the Permanent Regional Household Hazardous Waste Management Facility
RECOMMENDED ACTION(S):
TITLE
1. Adopt Resolution to authorize the Chairman of the Board of Supervisors and/or the County Administrative Officer to execute all documents relating to the operation of the Fresno County Regional Permanent Household Hazardous Waste Management Facility that are specifically required to be signed by the public agency’s ranking elected official or principal executive officer; and
2. Designate the Director of the Department of Public Works and Planning or Designee to execute all household hazardous waste management facility related documents that do not specially require the signature of the applicable public entity’s ranking elected official or principal executive officer.
REPORT
Approval of the recommended actions will authorize execution of all documents related to Fresno County Regional Permanent Household Hazardous Waste (HHW) Management Facility (HHW Facility). Permanent HHW Collection Facilities operated by a public agency are authorized under Permit By Rule (PBR) for collection of household hazardous waste and implementation of related programs required by the State. This item is countywide.
ALTERNATIVE ACTION(S):
Your Board may choose not to approve the recommended actions. Failure to approve the Resolution could disrupt the continued operation of the HHW Facility, as well as the collection of household hazardous waste and implementation of related programs required by the State.
FISCAL IMPACT:
There is no Net County Cost associated with the recommended actions. Operations and administration of the HHW Facility are funded through the AB 939 Memorandum of Understanding (MOU) Surcharge on solid waste generated in the County and disposed of in a landfill. Additional funding is provided through disposal cost reimbursements from qualified small business customers, known as Conditionally Exempt Small Quantity Generators (CESQGs).
DISCUSSION:
In 2014, the County began operating the HHW Facility at the American Avenue Disposal Site (AADS) in Kerman. California Code of Regulations (CCR) Title 22, Section 66270.11 requires certain documents be executed by either the public agency’s ranking elected official (Chairman of the Board of Supervisors, hereinafter “Chairman”) or principal executive officer (County Administrative Officer, hereinafter “CAO”). On February 24, 2014, Resolution No. 14-039 was adopted by the Board that authorized the Chairman and/or the CAO to execute and submit all facility-related documents to establish, permit and operate an HHW Facility and related household hazardous waste programs. The Resolution also authorized the Director of Public Works and Planning (Director) to sign documents that do not specifically cite CCR Title 22, Section 66270.11.
In 2022, the County began operating a new HHW Facility (Environmental Compliance Center - ECC) located at 1327 W. Dan Ronquillo Drive within the City of Fresno and concurrently initiated the closure of the former AADS facility. The recommended Resolution currently being presented updates the prior Resolution to maintain signature authority at the new HHW Facility, now that the AADS location has been closed. The CAO or Director is authorized to execute and submit, in the name of the County of Fresno, all PBR and HHW Facility related documents that do not specifically cite CCR Title 22, Section 66270.11, except for Uniform Hazardous Waste Manifests which may be the Director’s designee.
The permitting of an HHW Facility and related programs (such as the Local HHW Network for the collection of Universal Waste, sharps, and paint) provide County residents and CESQGs with an accessible and cost-effective options for the proper management of household hazardous waste. By utilizing a fully permitted HHW transporter and an experienced team for facility development and operations, the County seeks to protect the environment, enhance public health and safety, and support compliance with various regulations governing HHW management.
