SUBJECT:                     Retroactive Amendment I to Master Agreement for Specialized Residential Mental Health Services

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute a retroactive Amendment I to Master Agreement to update Star View Behavioral Health’s rates, effective July 1, 2023, with no change to the term of July 1, 2023 through June 30, 2025, or compensation maximum of $13,500,000.

REPORT

Approval of the recommended action will allow the Department of Behavioral Health to update the rate sheet for Star View Behavioral Health, Inc. following the revision of rates by their host county in accordance with California Advancing and Innovating Medi-Cal (CalAIM) payment reform requirements. This item is countywide.

 

ALTERNATIVE ACTION(S):

 

Should the Board not approve of the recommended actions, the Department would not be able to appropriately utilize the provider as the current Exhibit B-5 on file does not reflect the provider’s actual rates following the revision of CalAIM rates by their host county, Los Angeles.

 

RETROACTIVE AGREEMENT:

 

The current rates on Exhibit B-5 do not reflect the final CalAIM rates from Los Angeles County. When the provider, Star View Behavioral Health, Inc. submitted their rates for approval as part of the original agreement, Los Angeles County had not yet issued rates for the 24/7 programs such as psychiatric health facilities, and for day services labeled on the provider’s Exhibit B-5 as day treatment intensive. With the issuing of these rates, the Department seeks to retroactively amend the agreement to reflect these corrected rates, included as Revised Exhibit B-5, effective the first day of the agreement, July 1, 2023.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended action. The maximum compensation in FY 2023-24 is $6,500,000. The maximum compensation for the term is $13,500,000. The agreement is funded with Mental Health Realignment. Sufficient appropriations and estimated revenues are included in the Department’s Org 5630 FY 2023-24 Recommended Budget and will be included in future budget requests for the duration of the term. Actual costs will be determined by actual services provided.

 

DISCUSSION:

 

On July 1, 2023, the Board approved Master Agreement No. A-23-283 with licensed and credentialed facilities to provide specialized residential mental health services for County persons served, as mandated by the WIC and CCR Title 22.

 

Star View Behavioral Health, Inc. had submitted their Exhibit B-5 as part of the original agreement. After the Board had approved the Master Agreement and as counties are navigating the changes of CalAIM and Payment Reform, the Department of Behavioral Health was notified of the revision of CalAIM rates by Los Angeles County, resulting in the current need to update the provider’s Exhibit B. Revised Exhibit B-5 is retroactive to July 1, 2023, replacing in full the current Exhibit B-5.

 

Previously, the Director was authorized to adjust rates such as these; however, County Counsel has recommended that a rate adjustment such as this must go before the Board for approval.

 

OTHER REVIEWING AGENCIES:

 

The Fresno County Behavioral Health Board was informed of the recommended amendment at the August 2023 meeting.
