SUBJECT: Appointment In Lieu of Election for Freewater County Water District
Board of Directors
RECOMMENDED ACTION(S):
TITLE
Consider and appoint candidate Joshua P. Viau to the Freewater County Water District Board of Directors to a term set to expire December 3, 2027.
REPORT
Approval of the recommended action will allow the Fresno County Board of Supervisors to appoint a director to the Freewater County Water District (Freewater CWD) Board of Directors. The Freewater CWD is governed by the California Water Code and has a five-member board of directors elected to serve a four-year staggered term. This item pertains to a location in District 5.
ALTERNATIVE ACTION(S):
If the recommended action is not approved, the director position will remain vacant on the Freewater CWD Board.
FISCAL IMPACT:
There is no increase in Net County Cost associated with the recommended action.
DISCUSSION:
In accordance with California Elections Code Section 10515(b), the Board of Supervisors, as the supervising authority, shall appoint any person to the office who is qualified on the date when the election would have been held if no person has filed a declaration of candidacy for any office. The person appointed shall qualify and take office and serve exactly as if elected at a general district election for the office.
The Freewater CWD submitted an application from Joshua P. Viau to the Clerk of the Board of Supervisors on September 28, 2023. Mr. Viau did not file a declaration of candidacy for the November 7, 2023 Uniform District Election Law (UDEL) election. The applicant is qualified to serve on the Freewater CWD Board pursuant to California Water Code Section 30500. The Freewater CWD’s five-member board of directors are elected to serve a staggered four-year term. Approval of the recommended action will appoint Mr. Viau to the Freewater CWD Board of Directors to a term set to expire on December 3, 2027.
