SUBJECT:                     Agreement with the California Highway Patrol

RECOMMENDED ACTION(S):

TITLE

1.                     Approve and authorize the Chairman to execute Agreement No. 20R401000 with the California Highway Patrol (CHP) Central Division to fund law enforcement activities in a multi-agency law enforcement partnership titled Multi-Agency Gang Enforcement Consortium (MAGEC) effective July 1, 2020 through June 30, 2023 ($90,000); and

2.                     Approve and authorize the Chairman to execute the Contractor Certification Clauses and Conflict of Interest and Confidentiality Statement associated with the CHP Agreement.

REPORT

There is no additional Net County Cost associated with these actions.  The recommended actions will approve an agreement with the CHP to allow the District Attorney (DA) to reimburse the CHP for overtime costs associated with MAGEC activities. The reimbursement shall not exceed $30,000 per year.  This item is countywide.

ALTERNATIVE ACTION(S):

If the recommended agreement is not executed, the DA would not be able to reimburse the CHP’s overtime, and could impact the CHP’s participation in these law enforcement activities.

FISCAL IMPACT:

There is no increase in Net County Cost associated with the recommended actions.  The overtime costs will be offset using AB 118 Realignment MAGEC funds that will be included in the DA’s FY 2020-21 Recommended Budget for Org 2862.  Sufficient appropriations and estimated revenues will also be included in subsequent budget requests.  Reimbursement will not exceed $30,000 per year.

DISCUSSION:

The Multi-Agency Gang Enforcement Consortium (MAGEC), funded through AB 118 Realignment funds, has been in place since 1998.  The County Sheriff, Probation, District Attorney, municipal police, California Highway Patrol, and state and federal agencies formed the regional task force to identify, target, apprehend, and prosecute gang leadership and members responsible for the most violent gang offenses.

In addition to MAGEC’s gang enforcement activities, the unit routinely provides field training for gang officers throughout the region, as well as public awareness presentations and advice to schools and community service organizations.  MAGEC has a strong national reputation as a gang unit, and shares experience with other jurisdictions as they develop their own gang enforcement teams.

The District Attorney’s Office is the lead County agency of MAGEC, and the approval of the recommended actions will allow the reimbursement of overtime costs associated with MAGEC activities provided by the CHP Central Division Office.  With the exception of overtime payments, all salary and benefits for CHP officers will be paid by the CHP, and not reimbursed by the task force fund.  The recommended reimbursement will not exceed $30,000 per year or $90,000 for the three-year period. The Contractor Certification Clauses and Conflict of Interest and Confidentiality Statement are required by the CHP.
