SUBJECT:                     Amendment III to Agreement for Substance Use Disorder Primary Prevention Services

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute Amendment III to Agreement with Youth Leadership Institute for Substance Use Disorder Primary Prevention Services to update state-mandated requirements, effective upon execution, with no change to the term of July 1, 2021 through June 30, 2026, or compensation maximum of $7,077,625.

REPORT

Approval of recommended actions will allow the Department of Behavioral Health to update the Substance Use Disorder (SUD) prevention agreement with contract language from the California Department of Health Care Services (DHCS). The recommended amendments would allow the County to comply with various state-mandated requirements and continue receiving State funds through DHCS to finance County SUD prevention services, with no increase in Net County Cost. This item is countywide.

 

ALTERNATIVE ACTION(S):

 

If your Board does not approve the recommended actions, the Department will be out of compliance with several state-county contract requirements, jeopardizing State, Federal, and Behavioral Health Realignment revenues for the provision of substance use disorder prevention services and programs during the specified contract period.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended actions. The maximum compensation amount for recommended agreement ($7,077,625) is fully funded through the Substance Abuse Block Grant ($6,126,760), Coronavirus Response and Relief Supplemental Appropriations Act ($50,000), and American Rescue Plan Act ($900,865). Sufficient appropriations and estimated revenues are included in the Department’s Org 5630 FY 2022-23 Adopted Budget and will be included in subsequent budget requests for the duration of the term.

 

DISCUSSION:

 

On July 13, 2021, your Board approved Agreement No. 21-270 with YLI to provide substance use disorder primary prevention services for youth and young adults 10-20.

 

On April 19, 2022, your Board approved the First Amendment to the Agreement with YLI to add Coronavirus Response and Relief Supplemental Appropriations Act (CRRSAA) and American Rescue Plan Act (ARPA) revenue to the agreement to supplement the Friday Night Live (FNL) Program for youth and young adults ages 10-20.

 

On June 21, 2022, your Board approved the Second Amendment to the Agreement with YLI to add SABG and ARPA funds to the current agreement to supplement the FNL Program and SUD primary prevention for youth and young adults ages 10-20.

 

As part of DHCS’s efforts to implement California Advancing and Innovating Medi-Cal (CalAIM), guidance has been received from the state that adds, removes, and/or updates various State requirements within the state-county agreement.  Due to these ongoing implementation efforts, the Department anticipates future changes might be necessary for the SABG funded SUD primary prevention agreement in order to remain in compliance with changing state requirements.

 

The recommended amendment updates agreement language regarding Hold Harmless, Evaluation and Monitoring, Prohibition on Publicity, Data Security, and Compliance with Laws and Policies.  These changes would bring the Department into compliance with DHCS requirements. All other terms remain unchanged.
