SUBJECT:                     Amendment to American Rescue Plan Act - Coronavirus State and Local Fiscal Recovery Funds and Interdepartmental Agreement

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute First Amendment to Interdepartmental Agreement No. A-24-577 between the Internal Services Department, County Administrative Office, and Department of Public Works and Planning to reference the newly established General Services Department and Information Technology Services Department, and re-assign $506,000 of $10,701,183 available in American Rescue Plan Act - Coronavirus State and Local Fiscal Recovery Funds between programs, with no change to the term of April 19, 2022, through December 31, 2026.

REPORT

There is no increase in Net County Cost associated with the recommended action, which will authorize the Chairman to execute a First Amendment to the Interdepartmental Agreement (Agreement) between the Internal Services Department (ISD), which is now the General Services Department (GSD) and Information Technology Services Department (ITSD), County Administrative Office (CAO), and the Department of Public Works and Planning (PWP). The Amendment reassigns $506,000 in American Rescue Plan Act – Coronavirus State and Local Fiscal Recovery Funds (ARPA-SLFRF) previously obligated by conditions of use set forth by the United States Department of the Treasury’s (Treasury) Obligation Interim Final Rule (Obligation IFR), and redistributes the programs and related scopes of work between GSD and ITSD following the reorganization of the ISD. This item is countywide.

 

ALTERNATIVE ACTION(S):

 

There are no viable alternative actions. The recommended Amendment aligns with your Board’s prior approval to reorganize ISD into GSD and ITSD and redistribute available ARPA funds within GSD’s programs.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended action. Sufficient appropriations are included in the FY 2025-26 Adopted Budget for GSD-Facility Services Org 8935 and ITSD Org 8905 and the projects are fully funded with ARPA-SLFRF, which will be reimbursed from the Auditor-Controller/Treasurer-Tax Collector Org 1033 - Disaster Claiming, Fund 0026, Subclass 91021.

 

DISCUSSION:

 

On November 5, 2024, the Board approved the Agreement between ISD, CAO, and PWP to complete projects funded through ARPA-SLFRF related to the modernization of heating, ventilation, and air conditioning (HVAC) units at various County facilities serving the public; the upgrade and/or replacement of the emergency electrical systems (back-up power sources) at the Department of Public Health’s Brix-Mercer building; the purchase of communication improvements for public facilities; improvements in support of improved ventilation at the Facility Services Headquarters; and allow for necessary ventilation design and engineering, improvements, inspections, maintenance, and repairs to the HVAC systems, as well as generation and electrical maintenance and repairs to emergency generators at downtown public facilities.

 

On August 19, 2025, your Board approved an amendment to the County’s ARPA-SLFRF expenditure plan, which redesignated $506,000 in cost savings within GSD’s programs to help address anticipated cost overruns in GSD’s Heating/Ventilation Improvements in Public Facilities program. The recommended Amendment will not only properly identify the new totals approved by your Board for all of GSD’s programs, but will also appropriately assign funds between GSD and ITSD, clarifying each department’s fiscal responsibilities under the Agreement. Additionally, the recommended Amendment will update references to ISD as GSD and ITSD, respectively.

 

Approval of the recommended action will authorize the Chairman to execute the recommended Amendment, which updates the respective scopes of work to reference the appropriate departments, and reassigns $506,000 in previously obligated funds between GSD programs.
