RECOMMENDED ACTION(S):
TITLE
1. Receive Annual Boards, Commissions, and Committees Report pursuant to
County Administrative Officer Management Directive 2714.4; and
2. Eliminate the Community Parent and Guardian Review Committee based on State
Legislation and Rescind Resolution Number 23-377.
REPORT
Pursuant to County Administrative Officer Management Directive (MD) 2714.4, the County Administrative Officer (CAO) is presenting this item as the annual report of the activities of Boards, Commissions, and Committees (BCCs) and to provide your Board with recommendations as to whether any BCC should be eliminated because its purpose has been fulfilled, a legal requirement to have the BCC has been eliminated, the BCC sunset date has been reached, or for any other reason. This item is Countywide.
ALTERNATIVE ACTION(S):
There is no alternative action. Recommended Action number one is necessary based on MD 2714.4. Recommended Action number two is necessary to comply with Assembly Bill (AB) 1825.
FISCAL IMPACT:
There is no fiscal impact associated with this item.
DISCUSSION:
MD 2714.4 requires that the CAO compile for and present to the Board of Supervisors an annual report highlighting activities of BCCs and making recommendations as to whether any BCC should be eliminated because its purpose has been fulfilled, a legal requirement to have such a BCC has been eliminated, sunset date has been reached, or for any other reason.
This Agenda Item serves as the annual report for fiscal year 2024-2025, which was from July 1, 2024, to June 30, 2025. In order to fulfill the requirements of MD 2714.4, the CAO’s Office reached out via email to the contact person on file for each BCC and requested that they fill out and return a questionnaire.
Based on the responses from the BCCs and updated legislation from the State of California, the CAO recommends eliminating the following BCC:
• Community Parent and Guardian Review Committee
The Community Parent and Guardian Review Committee (Committee) was created by the Board by Resolution Number 23-377 on November 28, 2023, as a committee tasked with the review of current and incoming library books and materials intended for children, and determining if those materials contain age-inappropriate content.
AB 1825 was approved by California Governor Gavin Newsom on September 29, 2024. AB 1825 prohibits any body or commission designed to review the procurement, retention, or circulation of, or access to, library materials, from (1) proscribing the circulation or procurement of, or access to, library materials in a public library because of the topic addressed by the library materials or because of the views, ideas, or opinions contained in materials or (2) creating policies or procedures that limit or restrict access to library materials offered by the public library. The bill also prohibits library materials in a public library from being excluded, and access to library materials from being limited, solely on the basis of (1) specified protected characteristics of a subject of the library materials, an author of the materials, the sources of the library materials, or the perceived or intended audience for the library materials, (2) that the materials contain inclusive and diverse perspectives, or (3) that the materials may include sexual content, unless the content qualifies as obscene under United States Supreme Court precedent.
The passage and adoption of AB 1825 makes the elimination of the Committee necessary based on superseding State law. Since the Committee was created by a resolution, your Board would need to rescind the resolution to effectively eliminate the Committee.
