RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute an Agreement with California Health Collaborative for services to lead nutrition behavioral economics and food waste prevention and recovery intervention activities, effective upon execution, through September 30, 2029, which includes a three-year base contract and two optional one-year extensions, total not to exceed $1,670,715.

REPORT

There is no Net County Cost associated with the recommended action. Approval of the recommended Agreement will allow the Department of Public Health (Department) to continue nutrition education and obesity prevention activities through the CalFresh Healthy Living grant program. The contractor was selected through a competitive bidding process to implement the Healthy Retail Initiative program to help local retail stores that sell or distribute food and beverages to provide healthy food options and implement food waste prevention and recovery efforts. The recommended Agreement is funded through the California Department of Public Health (CDPH) Nutrition and Physical Activity Branch. This item is countywide.

ALTERNATIVE ACTION(S):

There is no viable alternative action. Should your Board not approve the recommended action, the Department would be unable to complete CalFresh Healthy Living grant activities as stipulated by the CDPH.

FISCAL IMPACT:

There is no increase in Net County Cost associated with the recommended action. The maximum compensation of the agreement is $1,670,715 ($334,143 annually) and will be fully funded through the CDPH because they administer a portion of the United States Department of Agriculture (USDA)-funded Supplemental Nutrition Assistance Program - Education (SNAP-Ed), known in California as the CalFresh Healthy Living program. The recommended Agreement follows the Federal Fiscal Year (FFY), with the exception that the first year will be treated like a 12-month year despite being 20 days longer. The entire term of the recommended Agreement will exceed the County standard five-year term by an additional 20 days. Sufficient appropriations and estimated revenues are included in Department’s Org 5620 FY 2024-25 Recommended Budget and will be requested in subsequent fiscal year budgets for the duration of the contract term.

DISCUSSION:

The Department has received CDPH SNAP-Ed grant funds since 2013 to provide nutrition education and obesity prevention activities and interventions for low-income County residents. The CalFresh Healthy Living program in California offers a comprehensive public health approach that enables partners to work together to prevent obesity and serve California’s individuals and families with low incomes.  Requirements of the FFY 2024-2026 grant award are to provide evidenced based interventions and activities related to improving healthy eating and active living behavior and environments for the primary prevention of chronic disease, with a focus on creating equitable conditions that allow for community members to achieve their most optimal health. The goal of healthy retail is to transform the food retail environment into a place that promotes health by creating better access to healthier foods within retail locations, and through implementation of food recovery efforts that enable the distribution of recovered food back into the local community.

On March 29, 2024, the Department and the Internal Services Department - Purchasing Division released a Request for Proposal (RFP) for services to lead nutrition behavioral economics and food waste prevention and recovery intervention activities for implementation of the CalFresh Healthy Living program’s Healthy Retail Initiative.  RFP No. 24-055: The Healthy Retail Initiative was released to over 60 agencies who were notified through Public Purchase. The Healthy Retail Initiative aims to educate local retail food store owners that sell or distribute food and beverages, on the benefits and impact of working on creating better access to healthier foods within the store and implementing a food waste prevention and recovery effort. The RFP closed on April 26, 2024, with two proposals received. The accepted proposal was reviewed on May 10, 2024, by an evaluation committee comprised of staff from the Department of Public Health and the Department of Social Services. The committee recommended the proposal submitted by California Health Collaborative for funding.

Upon approval by your Board, the recommended agreement will be effective upon execution through September 30, 2027, with an option for two additional one-year terms dependent upon satisfactory performance outcomes and availability of funding. The recommended agreement will allow the Director to approve minor budget modifications up to ten percent (10%) of the maximum compensation without altering the total maximum compensation outlined in the agreement, which will allow California Health Collaborative to continue providing services while being able to utilize the entire budget.  The total term of the recommended agreement exceeds the County standard five-year term by an additional 20 days without increasing the maximum compensation amount.
