SUBJECT:                     Right-of-Way Acquisition for HBP - Outside Canal Bridge

                     on Russell Avenue Project - Federal Project No. BRLS-5942(195)

 

RECOMMENDED ACTION(S):

TITLE

Authorize the Chairman to execute the Right-of-Way Contracts and Temporary Construction Permits required for the HBP - Outside Canal Bridge on Russell Avenue Project for a total monetary consideration of $2,700.

REPORT

Approval of the recommended action will authorize the purchase of additional right-of-way adjacent to Russell Avenue and Temporary Construction Permits required facilitate the replacement of the Outside Canal Bridge on Russell Avenue Project (shown on Exhibit A, attached). 

 

ALTERNATIVE ACTION(S):

 

The Board may reject the purchase of this right-of-way and temporary construction permits. This would prevent the County from obtaining the necessary right-of-way and temporary construction permits to proceed with the project. If the recommended action is not approved, the project will be cancelled and funding previously received for the project would have to be returned.

 

FISCAL IMPACT:

 

There will be no Net County Cost associated with the recommended action. Warrants or checks will be drawn on the Road Fund 0010, made payable to the individual grantors listed below.  This project is eligible for reimbursement under the Federal Highway Bridge Program (HBP). The HBP program will provide up to 88.53 percent of the funding for the purchase of the right-of-way acquisitions and temporary construction permits. The County’s share of the local match will be paid out of the Road Fund. Sufficient appropriations for this project are included in the FY 2017-18 Public Works and Planning - Roads Org 4510 Adopted Budget.

 

The property owner names, addresses and the basis of the compensation associated with these parcels are as follows:

 

Parcels 1 & 3 - Maverick Pistachios, LLC, 652 West Cromwell Avenue, Suite 103, Fresno, CA 93711 - $2,100. This payment is for a 0.041 acre and 0.025 acre canal access deeds, a 0.087 acre and 0.072 acre temporary construction permits and severance damages to the remainder, if any. 

 

Parcels 4 & 5 - Panoche Drainage District, 52027 West Althea Avenue, Firebaugh, CA 93622 - $600. This payment is for a 0.004 acre and 0.008 acre canal access deeds, a 0.216 acre and 0.264 acre temporary construction permits and severance damages to the remainder, if any. 

 

Of the total compensation provided pursuant to this agenda Item, $750 is for two Grant Deeds acquired on behalf of Central California Irrigation District (CCID), with no useful life to the County, and $1,950 is for a temporary construction permit with a useful life of 12 months.

 

DISCUSSION:

 

The proposed project consists of replacing the Outside Canal Bridge on Russell Avenue, 3.9 miles north of Nees Avenue.  The proposed work consists of replacing the bridge with pre-cast bridge structure that meets current standards.   

 

The Grant Deeds obtained for these parcels are vested in CCID and sent to them for acceptance by their Board.  

 

It is anticipated that construction may commence in the fall of 2018.
