SUBJECT:                     Retroactive Amendments to Agreements with the Tobacco Prevention Program

 

RECOMMENDED ACTION(S):

TITLE

1.                     Approve and authorize the Chairman to execute retroactive Third Amendment to Agreement with NMK Research and Consulting to extend the term of the existing Agreement for evaluation services of the Tobacco Prevention Program by six months from January 1, 2022 to June 30, 2022 with no change to the compensation maximum of $103,256.   

 

2.                     Approve and authorize the Chairman to execute retroactive Second Amendment to Agreement with California Health Collaborative for a Policy Change Project extending the term by six-months from January 1, 2022 to June 30, 2022 and increasing the maximum by $30,500 to a total of $280,500. 

REPORT

There is no additional Net County Cost associated with the recommended actions. Approval of the first recommended action shifts unspent funds ($15,067) to FY 2021-22 budget and extends the term to allow NMK Research and Consultation (NMK) to complete the final evaluation report with analysis for the 2017-2021 Tobacco Control Plan, including the required Communities of Excellence survey results.  Approval of the second recommended action will allow California Health Collaborative (CHC) more time and the necessary funding to cover operational costs through June 30, 2022 to assist the Tobacco Prevention Program (TPP) with developing the enforcement and implementation plan disseminating the data collected and work to find solutions to best address the communities concern over youth access to tobacco products in the City of Fresno. This item is countywide.

 

ALTERNATIVE ACTION(S):

 

Should your Board not approve the recommended amendments, the local TPP would not be able to complete required objectives in the 2017-2021 Comprehensive Tobacco Control Plan and risk noncompliance and possible future funding reductions.     

 

RETROACTIVE AGREEMENT:

 

The recommended amendments are retroactive to July 1, 2021 due to obtaining final confirmation from the California Department of Public Health (CDPH) in October 2021 regrading changes in scope of work activities and is being brought to your Board in accordance with the agenda item processing timelines. 

 

FISCAL IMPACT:

 

There is no additional Net County Costs associated with the recommended actions. The recommended amendments are fully funded with the CDPH Tobacco Control Program Propositions 99 and 56 grant funds.

 

If approved, the first action will revise the last two years of NMK’s budget without increasing the maximum compensation of $103,256 as follows:

FY 2020-21   July 01, 2020   June 30, 2021     $30,818 (reduced $15,067)

If approved, the second action will extend the term six-months and increase CHC’s maximum from $250,000 to $280,500 as follows:

Sufficient appropriations and estimated revenues are included in the Department of Public Health’s Org 5620 FY 2020-21 Adopted Budget and will be included in future budget requests.  

                                

DISCUSSION:

 

On December 11, 2018, the Board approved a five-year agreement No. 18-715 with NMK Research and Consulting for a dedicated external evaluator to provide comprehensive evaluation services for the Department’s TPP. On March 24, 2020, the Board approved First Amendment No. 18-715-1 to increase the maximum by $13,384 and revise the scope of work to add new survey activities. On April 13, 2021 the Board approved Second Amendment No. 18-715-2 to reduce the term to align the scope of work activities and budget with the updated State allocation funding. If approved, the recommended Third Amendment will shift unspent funds to FY 2021-22 budget and extends the term through June 30, 2022 to allow NMK to complete the survey on the Communities of Excellence process and finish key informant interviews for the next tobacco campaign. 

 

On September 10, 2019 the Board approved agreement No. 19-448 with CHC to implement a policy system and/or environmental change project using the Community Action Model (CAM) development process. On April 13, 2021, the Board approved First Amendment No. 19-448-1 to increase the maximum from $200,000 to $250,000 and extend the term through December 31, 2021.  If approved, the recommended action will extend the term through June 30, 2022 and increase the maximum by $30,500 to allow CHC CAM Project to work on identifying solutions to address the issue of youth access to tobacco products within the unincorporated County communities. Once a solution has been selected, CHC CAM project will work on developing the enforcement and implementation plan.   

 

A new tobacco control campaign is set to begin January 1, 2022 through June 30, 2025, with revised activities and funding. The Department anticipates returning to your Board in 2022 with additional actions to continue supporting the TPP.
