RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute Amendment I to Agreement A-22-480 with Nightingale Dispute Consultants, Inc., dba Nightingale Resolutions to add the District Attorney’s Office to the Agreement for transformative and conflict training resolution services, effective upon execution with no change in the term to October 31, 2025, amending the scope of services and increasing the maximum by $39,750 to a total of $263,400.

REPORT

There is no increase in Net County Cost associated with the recommended action, which will add the District Attorney’s Office (DA) to the agreement and increase the maximum compensation accordingly. The original agreement was with the Probation Department for a three-year term, ending October 31, 2025, with two optional one-year extensions, and contained a maximum compensation not to exceed $223,650.  The recommended amendment will amend the scope of services to include the DA and increase the maximum compensation amount by $39,750 for the entire term, ending October 31, 2025 (with two optional extensions), allowing both the Probation Department and the DA to receive leadership and conflict resolution training services. This item is countywide.

ALTERNATIVE ACTION(S):

If the recommended action is not approved, Nightingale Dispute Consultants, Inc., dba Nightingale Resolutions will not be able to provide these transformative leadership and conflict training resolution services to the DA.

FISCAL IMPACT:

There is no increase in Net County Cost associated with the recommended action. The recommended amendment will amend the scope of services and increase the maximum compensation amount by $39,750, to a total of $263,400. Sufficient appropriations are included in the FY 2023-24 Adopted Budgets for Probation Org 3430 and the District Attorney Org 2860. Sufficient appropriations and estimated revenues for the optional term extensions will be included in subsequent budget requests for the Probation Department Org 3430 and the District Attorney Org 2860.

DISCUSSION:

Nightingale Resolutions equips organizations to develop a culture built on mutual respect, collaboration, and accountability.  Services focus on teamwork, communication, collaboration, and culture.  The County executed Purchase Orders for the Probation Department to receive these services from Nightingale Dispute Consultants, Inc. for the following terms: February 7, 2019 through August 31, 2019, October 1, 2020 through June 30, 2021, and July 1, 2021 through June 30, 2022.  Also, a Limited Purchase Order was completed for the Probation Department for July 2022.  On October 25, 2022, the County executed Board agreement A-22-480 (Agreement) with Nightingale Resolutions to provide transformative leadership and conflict resolution services for the Probation Department.  The agreement was a three-year base contract with two optional one-year extensions and contained a maximum compensation not to exceed $223,650.

The recommended amendment to the agreement amends the scope of services to include the DA and increases the maximum contract value to $263,400.  Approval of the recommended action will allow the DA to receive these services to develop its leadership team, grow professional capacities, and foster an environment of unity within the workplace. The transformative leadership and conflict resolution training will include executive coaching, collaborative meetings, task forces, and training resources. Existing services specific to the Probation Department include "Task Forces" that involve topics of employee retention, succession planning, access to information, unity, appropriately inclusive decision making, progress tracking, evidence-based practice, and increasing field interactions. Services specific to the DA that will be added by the recommended amendment include a “Collaborative Priority Development Opportunity,” which is made up of team building activities designed to locate specific areas of collaboration and initiate constructive dialogue and will provide the ability to work towards common goals across the chain of command.
