SUBJECT:                     Appointments in Lieu of Special Election for Broadview Water District

 

RECOMMENDED ACTION(S):

TITLE

Accept Certification pursuant to Elections Code section 10515 regarding declarations of candidacy for eligible positions for Broadview Water District; and appoint, in lieu of a special election, candidates who filed declarations of candidacy unopposed.

REPORT

Approval of the recommended actions will accept the Certification pursuant to Elections Code Section 10515 from Broadview Water District and appoint persons who have filed declarations of candidacy to its board positions. This item pertains to District 1.

 

ALTERNATIVE ACTION(S):

 

There is no viable alternative. Elections Code section 10515 requires the Board of Supervisors to either make Landowner District Board appointments in lieu of election or to utilize the County’s established appointment process, as performed by the Clerk of the Board.

 

DISCUSSION:

 

There are five (5) seats on the Broadview Water District (“District”) Board. On July 27, 2023, the District requested that your Board make an appointment to their District Board per Government Code section 1780(h) as their District Board had fallen below a quorum. On August 8, 2023, your Board appointed Director Allison Febbo to the District Board to fill a vacancy and provide the District Board with a quorum. However, the deadline for the District to call their 2023 general election had already lapsed.

 

On May 6, 2024, the District Board adopted Resolution No. 2024-01, calling a special election to fill its vacant and expired positions. On June 25, 2024, the District provided the Clerk of the Board their request for your Board to accept their Certification pursuant to Elections Code section 10515, which lists persons who have filed declarations of candidacy, and make appointments in lieu of their special election.

 

Per Elections Code section 10515(a)(3), the District has certified that, “in the case of directors to be elected from the district at large, the number of persons who have filed a declaration of candidacy for director at large does not exceed the number of offices of director at large to be filled at that election.”
