SUBJECT: Retroactive Second Amendment to Agreement with Superior Court of California
RECOMMENDED ACTION(S):
TITLE
Approve and authorize the Chairman to execute a retroactive Second Amendment to Agreement No. 23-357 with the Superior Court of California, County of Fresno for Court case management system, door access, Wi-Fi, badge, and printer services, effective July 1, 2026, with no change to the term of August 1, 2023 to July 31, 2028, updating the Court’s services rates, and increase the maximum by $79,320 to a total of $679,320.
REPORT
There is no increase in Net County Cost associated with the recommended action. Approval of the recommended action will authorize a retroactive Second Amendment to Agreement No. 23-357 with the Superior Court of California, County of Fresno (Court), effective July 1, 2026, to update the Court’s schedule of service rates, increase the annual and total maximum compensation under the Agreement, and ensure the County’s continued access to Court case management system (CMS), door access, Wi-Fi, badge, and courtroom printer services for participating County departments. This item is countywide.
ALTERNATIVE ACTION(S):
There is no viable alternative action. If your Board does not approve the recommended action, the County will be unable to reimburse the Court for services at the revised rates effective July 1, 2026, which may impact continued access to Court services provided under the Agreement.
RETROACTIVE AGREEMENT:
The Court notified the County of the updated service rates on June 11, 2026. The proposed Second Amendment is retroactive to July 1, 2026, to coincide with the Court’s implementation of revised service rates following completion of a Court time cost study. Additional time was required to coordinate the revised rates and proposed agreement updates with participating County departments.
FISCAL IMPACT:
There is no increase in Net County Cost associated with the recommended action. Participating County departments fund their respective Court service costs within existing departmental appropriations. The recommended amendment increases the annual maximum compensation for Years 4 and 5 and the total maximum compensation under the Agreement to accommodate the Court’s revised service rates effective July 1, 2026. Sufficient appropriations are included in the FY 2026-27 Recommended Budget and will be included in subsequent budget requests for the respective departments.
DISCUSSION:
On July 18, 2023, the Board approved Agreement No. 23-357 with the Court for County department access to the Court’s CMS, automated door access, identification badges, Wi-Fi usage, and applicable printing services necessary to conduct County business within the Court facilities.
On April 7, 2026, your Board approved the First Amendment to Agreement No. 23-357 to update references from the Court’s Odyssey CMS to the eCourt CMS following the Court’s system transition, with no changes to compensation.
Following completion of a Court time cost study, the Court adopted revised service rates effective July 1, 2026. While most revised service rates remain within the Agreement’s allowable annual increase limitation, the proposed badge fee exceeds the Agreement’s 20% annual rate increase limitation. As a result, Board approval is required to amend the Agreement. The revised rates include increases for case management system access, door access, Wi-Fi, badges, and printer services.
Approval of the recommended actions will update Exhibit A to reflect the Court’s revised rates, increase the annual maximum compensation for Years 4 and 5 and the total maximum compensation under the Agreement, and ensure continued access to these Court services for participating County departments.
