SUBJECT: Appointment to the Silver Creek Drainage District Board in accordance with Government Code Section 1780
RECOMMENDED ACTION(S):
TITLE
Approve the appointment of Mark Coit to the Silver Creek Drainage District Board, for a short term expiring November 28, 2025, to fill a vacancy.
REPORT
There is no additional Net County Cost associated with the recommended action. Approval of the recommended action will allow your Board to appoint Mr. Coit to the Silver Creek Drainage District (District) Board. This item pertains to a location in District 1.
ALTERNATIVE ACTION(S):
Your Board may order the District Board to call an election to fill the vacancy.
FISCAL IMPACT:
There is no increase in Net County Cost associated with this action.
DISCUSSION:
Government Code Section 1780 provides that when a vacancy occurs in a district, the remaining members of the district board may fill the vacancy either by appointment or by calling an election. If the vacancy is not filled by the district board by appointment and the district board has not called for an election, the Board of Supervisors may appoint a person to fill the vacancy or may order the district to call an election to fill the vacancy.
The District Board consists of five (5) division seats. The Division 4 position is currently vacant. Mark Coit submitted an application to the District, which indicated Mr. Coit was eligible to serve on the District Board. The Clerk of the Board’s office received Mr. Coit’s application from the District on May 15, 2024.
By making an appointment, the vacant Division 4 seat will be filled on the District Board without the District incurring the cost of an election. If appointed by your Board, Mr. Coit will serve for a short term that began November 24, 2023, and will expire November 28, 2025, in accordance with Government Code Section 1780(f)(1).
