RECOMMENDED ACTION(S):

TITLE

Consider and appoint applicant Donald Lee Dukleth to the Sierra Resource Conservation District Board of Directors to a term set to expire on November 27, 2026.

REPORT

Approval of the recommended action will appoint a director to a vacancy on the Sierra Resource Conservation District (Sierra RCD) Board of Directors. The Sierra RCD is governed by California Public Resources Code, section 9001 et seq. This item pertains to District 5.

 

ALTERNATIVE ACTION(S):

 

If the recommended action is not approved, the seat will remain vacant.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended action. The recommended action is necessary to fill a vacancy on the Sierra RCD Board of Directors.

 

DISCUSSION:

 

Resource Conservation Districts (RCD) are governed by California Public Resources Code, section 9001, et seq. Under section 9314(b), an RCD may request that the Board of Supervisors of the principal county appoint directors, in lieu of holding elections, through a resolution of its board of directors. Such a resolution remains in effect until rescinded by the board or upon receipt of a valid petition requesting rescission by the elections official. Additionally, California Public Resources Code, section 9316, provides that any vacancy in the office of the director appointed under section 9314 is to be filled by the Board of Supervisors of the principal county for the remainder of the unexpired term, in the manner prescribed by section 9314.

 

On June 1, 2016, the Sierra RCD submitted an executed standing resolution to the County Clerk/Registrar of Voters, requesting the Board of Supervisors to appoint its directors in lieu of an election pursuant to California Public Resources Code, section 9314(b).

 

On November 29, 2022, the Board appointed Gary L. Temple as a director of the Sierra RCD Board of Directors for a four-year term pursuant to California Public Resources Code, section 9314(b). Mr. Temple resigned from the office on August 17, 2024 and the seat has remained vacant due to a lack of applicants for the director position.

 

On March 11, 2026, the Sierra RCD contacted the Clerk of the Board of Supervisors, requesting your Board appoint Donald Lee Dukleth to fill the vacancy and serve the remainder of the term set to expire on November 27, 2026. The Clerk of the Board of Supervisors received a Boards, Commissions, Committees (BCC) Application Form for Mr. Dukleth on March 11, 2026, showing that he is qualified to serve on the Sierra RCD Board of Directors.

 

On March 20, 2026, the County Clerk/Registrar of Voters posted a special notice of vacancy in its office, on its website, with the Clerk of the Board of Supervisors, and at the Fresno County Library in compliance with California Government Code, section 54974.
