SUBJECT:                     Amendment to Master Agreement with City of Fresno for Maintenance and Repair of Shared Infrastructure

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize Chairman to execute an Amendment to a Master Dual Jurisdiction Cooperative Agreement with the City of Fresno for construction projects for repairs and/or improvements, and certain types of maintenance of public roads and associated facilities for which the City and County share jurisdictional responsibility.

REPORT

Approval of the recommended action will extend an agreement between the City of Fresno and Fresno County for dual jurisdiction transportation improvement and maintenance projects. Specific terms applicable to any particular project will continue to be established via a Project Specific Supplement Agreement (PSSA), which will be executed by the Director of the City of Fresno’s Department of Public Works and the County’s Director of Public Works and Planning. The authority to execute a PSSA applicable to each project was delegated to the County Director with the execution of the Master Dual Jurisdiction Agreement on September 10, 2019. This item is countywide.

 

ALTERNATIVE ACTION(S):

 

Your Board may choose to not approve the recommended action and the Agreement will expire. However, transportation improvement and maintenance projects for which the City and County share jurisdictional responsibility will require separate agreements to be approved by the Board of Supervisors.

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended action.  The projects covered by the amendment to the Agreement will be identified within each agency’s budgets and will follow each agency’s approval protocols.  Sufficient appropriations and estimated revenues are included in the Department’s Roads Org 4510 FY 2024-25 Adopted Budget.

 

DISCUSSION-:

 

On September 10, 2019, the Board approved a Master Dual Jurisdiction Agreement with the City of Fresno for transportation improvement and maintenance projects for which the City and County share jurisdictional responsibility.  Through this Agreement, project specific agreements have been executed for many projects.  These include Jensen Reconstruction (3 projects, 2 led by the County, 1 by the City), HAWK Flashing Beacons, Cedar Complete Streets, and the McKinley and Blythe Intersection Project.  This Agreement will expire on December 31, 2024, unless extended by mutual agreement between the City and County.  The Amendment to the Agreement will extend the term for an additional period of 5 years, with an expiration date of December 31, 2029.

 

It is in the best interest of both the City and County to maintain the Agreement in order to complete projects for which both are responsible in a timely fashion.

 

OTHER REVIEWING AGENCIES:

 

The Amendment to the Master Agreement was submitted by the City of Fresno and was executed on December 5, 2024.
