SUBJECT:                     Amendment I to Agreement A-22-204 Psychiatric Inpatient Concurrent Review Program

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute Amendment I to Participation Agreement with California Mental Health Services Authority for Psychiatric Inpatient Concurrent Review extending the term by six months from January 1, 2025 to June 30, 2025; and increasing the maximum by $446,777 to a total of $1,365,000.

REPORT

Approval of the recommended action will allow the Department of Behavioral Health (Department) to continue to participate in the Psychiatric Inpatient Concurrent Review Program by extending the agreement through June 30, 2025. There is no additional Net County Cost associated with the recommended action. This item is countywide.

 

ALTERNATIVE ACTION(S):

 

Should the Board not approve of the recommended actions the Department would no longer participate in the Psychiatric Inpatient Concurrent Review Program. The Department will need to rely on internal personnel, which may redirect them from current responsibilities and significantly deplete resources. 

 

FISCAL IMPACT:

 

There is no increase in Net County Cost associated with the recommended action. The maximum amount of the agreement $1,365,000 will be fully offset with Realignment funds. Sufficient appropriations and estimated revenues are included in the Department’s Org 5630 FY 2024-25 Adopted Budget.

 

DISCUSSION:

 

On September 14, 2010, the Board approved Agreement No. 10-489 with the California Mental Health Services Authority (CalMHSA), authorizing the Department to join the CalMHSA Joint Powers Authority (JPA), to develop, implement, administer, and provide fiscal oversight of Mental Health Services Act (MHSA).

 

On June 18, 2013, the Board approved Amendment No. 10-489-1 with CalMHSA, broadening the stated purpose for the JPA to allow CalMHSA to perform additional services for behavioral health departments acting alone or in collaboration with other departments, which included but was not limited to data management, research, and development.

 

On May 17, 2022, the Board approved Agreement A-22-204 with CalMHSA allowing the Department to participate in Psychiatric Inpatient Concurrent Review program with a total budget of $918,223. The Agreement allowed Keystone Peer Review Organization (KEPRO), under the oversight of CalMHSA to conduct concurrent review and authorization of inpatient psychiatric services on behalf of the County.

 

Per the BHIN 19-026, Mental Health Plans (MHPs) are required to conduct concurrent review and authorization for all psychiatric inpatient hospital services and psychiatric health facility services within 72 hours. The amendment will extend the current contract to June 30, 2025 and will enable the Department to continue providing services without interruption. This extension will also allow the Department the necessary time to develop and negotiate a new contract with CalMHSA that aligns with the County’s long-term goals.

 

The recommended agreement varies from the standard county template as it was drafted by CalMHSA and is utilized by CalMHSA to execute Participation Agreements with different counties and is consistent statewide. The Department believes that the benefits of the recommended amendment outweigh any potential risks and recommends approval of the
