SUBJECT:                     First Amendment to Agreement No. A-24-312 with California Forensic Medical Group, Incorporated 

 

RECOMMENDED ACTION(S):

TITLE

Approve and authorize the Chairman to execute First Amendment to Agreement No. A-24-312 with California Forensic Medical Group Incorporated to provide CalAIM Justice-Involved pre-release services to youth detained at the County Probation Department Juvenile Justice Campus, effective upon execution with no change to term, and increasing the maximum compensation by $121,388 to $22,280,136.

REPORT

There is no additional Net County Cost with the recommended action. Approval of the recommended action will allow for implementation of targeted pre-release services for juvenile wards at the Juvenile Justice Campus (JJC) under the California Advancing and Innovating Medi-Cal (CalAIM) Justice-Involved (JI) Reentry Initiative. Funding for the recommended amendment will be through Providing Access and Transforming Health (PATH) Capacity Building Program grant funds and Medi-Cal Federal Financial Participation. This item is county-wide. 

 

ALTERNATIVE ACTION(S):

 

If the recommended action is not approved, the County will not be in compliance with legally-required CalAIM JI reentry mandates at the JJC.

 

FISCAL IMPACT:

 

There is no additional Net County Cost with the recommended action. The recommended amendment increases the maximum compensation for FY 2025-26 by a one-time IT start-up and integration cost of $5,400 as funded by the PATH grant, and incorporates increases for the maximum compensations for FY 2027-28 and FY 2028-29 by a fee of 7% of the sum of Probation’s gross Justice-Involved Medi-Cal reimbursement claims with an estimated annual maximum of $40,937. The FY 2026-27 fee is pro-rated to reflect the September 1, 2026 Go-Live, for an estimated amount of $34,114. The JI Medi-Cal reimbursement fees performed under the recommended amendment are paid for with the revenue received from CalAIM JI Reentry Initiative. Sufficient appropriations and estimated revenues are included in Probation Department’s Org 3440 FY 2025-26 Adopted Budget, and will be included in budget requests for the duration of the term.

 

DISCUSSION:

 

California is the first state to offer Medi-Cal services to youth and adults in correctional settings up to 90 days before release, expanding access beyond the traditional post-release model. Through a federal Medicaid 1115 waiver, the California Department of Health Care Services (DHCS) is establishing a coordinated reentry process to connect individuals with needed health care services upon release.

 

On June 18, 2024, the Board approved an agreement with California Forensic Medical Group, Incorporated (Wellpath) for comprehensive medical and behavioral health care services, including substance use disorder services, for youth detained at the JJC.

 

On March 3, 2026, your Board approved an agreement with WestCare California, Inc. to provide CalAIM JI pre-release care coordination services at the JJC.

 

The recommended amendment will authorize Wellpath to provide CalAIM JI reentry services consistent with Probation’s CalAIM JI Readiness Assessment, with an anticipated Go-Live date of September 1, 2026. Under the recommended amendment, Wellpath will collaborate with WestCare and the County’s Managed Care Plans to develop reentry care plans and coordinate services for eligible youth transitioning back into the community. Additionally, Wellpath’s subcontracted billing vendor, Medusind, Inc., will conduct audits and provide quality assurance to ensure the claims submitted for the 90-day pre-release medical, mental health, and substance use disorder services delivered at the JJC are accurate and compliant with State and Federal requirements. Under the recommended amendment, Medusind, Inc. will receive 7$ % of the total gross revenue collected by the County. Wellpath will also ensure that its staff are credentialed to bill Medi-Cal and will provide training to support accurate and complete billable documentation.

 

The recommended amendment updates the insurance requirements as follows:

 

1.                     All Risk Property Insurance has been included and capped at $50,000 per claim.

2.                     Professional Liability has decreased from $10,000,000 per occurrence and an aggregate of $10,000,000 to $3,000,000 per occurrence and an aggregate of $6,000,000.

 

Risk Management identified significant risk exposures with the services performed by Wellpath, and recommended the additional insurance requirements. However, Wellpath stated these requirements exist under their agreement for Jail medical and behavioral health care services. Probation believes the benefits of entering into the recommended amendment outweigh these risks, and is accepting this insurance as a prudent business decision.
