SUBJECT: Second Hearing and Adoption of Ordinance Calling for a Special Election to Amend Section 15 of the Fresno County Charter
RECOMMENDED ACTION(S):
TITLE
Conduct second hearing and adopt an Ordinance calling for a special election to be held on March 5, 2024, for the purpose of submitting to the voters of the County a measure to amend Section 15 of the Fresno County Charter related to the election date and term of office of the County’s elective officers, and directing the consolidation of the special election with the Statewide Primary Election to be held on the same day; and waive reading of the Ordinance in its entirety.
REPORT
Approval of the recommended action will adopt the Ordinance calling for a special election for the purpose of submitting to the voters a measure to amend Section 15 of the Fresno County Charter (“County Charter”) and consolidating that election with the March 5, 2024 Statewide Primary Election. This item is countywide.
ALTERNATIVE ACTION(S):
If your Board does not adopt an Ordinance by December 8, 2023, the special election cannot be held on and consolidated with the Statewide Primary Election on March 5, 2024.
FISCAL IMPACT:
Costs to place the County Charter amendment measure on the ballot for the March 5, 2024 Consolidated Statewide Primary Election are estimated by the County Clerk/Registrar of Voters at approximately $30,000.
DISCUSSION:
At the August 22, 2023 Board of Supervisors meeting, your Board adopted Resolution No. 23-287 to place a measure proposing to amend Section 15 of the County Charter related to the election date and term of office of the County’s elective officers on the March 5, 2024 Consolidated Statewide Primary Election ballot.
To call for the Special Election placing the County Charter amendment measure on the March 5, 2024 Consolidated Statewide Primary Election ballot, the Board must adopt an Ordinance in accordance with Government Code Section 23730.
On October 24, 2023, the Board conducted the first hearing on the proposed Ordinance. The Ordinance, if adopted, would take effect immediately pursuant to Elections Code Section 9141 and Government Code Section 25123.
