SUBJECT: Agreement with the State of California Employment Development Department
RECOMMENDED ACTION(S):
TITLE
Approve and authorize the Chairman to execute Agreement with the State of California Employment Development Department (EDD) to provide employment information to the Sheriff’s Office for the purpose of obtaining current employment data for felony victims, suspects, missing persons, potential witnesses, or persons for whom a felony arrest warrant has been issued from January 1, 2026 through December 31, 2028 in the amount of $1,934.
REPORT
There is no additional Net County Cost associated with the recommended action, which will allow the Sheriff’s Office to obtain employment data for both victims and suspects, to enable the Sheriff’s Office to contact victims and suspects at work during investigations. This item is countywide.
ALTERNATIVE ACTION(S):
There is no alternative action. If your Board does not approve the recommended action, the Sheriff’s Office will not be able to obtain employment data for felony victims, suspects, missing persons, potential witnesses, or persons for whom a felony arrest warrant has been issued.
FISCAL IMPACT:
There is no increase in Net County Cost associated with the recommended action; costs incurred as a result of utilizing the recommended agreement are not to exceed $1,934 for the three-year term for January 1, 2026 through December 31, 2028. Sufficient appropriations and estimated revenues are included in the Department’s FY 2025-26 Adopted Budget for Org 3111 and will be included in future budget requests.
DISCUSSION:
On November 29, 2022, your Board approved an agreement with EDD to provide employment information to the Sheriff’s Office effective January 1, 2023 through December 31, 2025. The recommended agreement will allow EDD to continue to provide employment information to the Sheriff’s Office for the time period of January 1, 2026 through December 31, 2028.
Obtaining current employment information for felony victims, suspects, missing persons, potential witnesses, or persons for whom a felony arrest warrant has been issued is a necessary resource for Sheriff’s Office investigations. The total compensation amount of the recommended agreement in the amount of $1,933.74 covers all 3 years of the term of the recommended agreement, and has been computed based on an estimated 60 Social Security Numbers (SSN) processed per quarter as follows:

The recommended agreement requires that the Sheriff’s Office use the confidential information obtained from EDD consistently with the limitations set forth by the California Trust Act (California Government Code sections 7282 et seq.) and the California Values Act (California Government Code sections 7284 et seq.).
The recommended agreement contains extensive required administrative, management, use, duplication and redisclosure, and physical safeguards with which the Sheriff’s Office must comply to protect the confidential and sensitive information disclosed under the agreement. The recommended agreement also requires that each Sheriff’s Office employee sign a confidentiality agreement agreeing to keep all confidential and sensitive records of the EDD confidential.
The recommended agreement also requires that the County indemnify the EDD from any loss, cost, damage or liability resulting from violation of certain statutes related to information security requirements.
The Indemnity Agreement outlines the penalties for misuse of the EDD information, which include civil fines, criminal penalties, and imprisonment in the County jail for up to a year. It also provides that the Fresno County Sheriff’s Office agrees to indemnify the EDD against any liability costs, damages, attorney’s fees, and other expenses the EDD may incur as a result of any unauthorized use of the personal, sensitive, or confidential information or any violation of the Confidentiality Agreement by any and all employees of the Sheriff’s Office.
The Sheriff’s Office believes that the benefits of the recommended Agreement outweigh any potential risks and recommends approval of the agreement as a prudent business decision and will update the Sheriff’s Office policies following your Board’s approval, but before the Sheriff’s Office begins obtaining employment data from the EDD, to comply with EDD requirements.
