SUBJECT:                     Application for Discharge of County Officials from Accountability for Collecting Overpayments to Jessica McKenzie from July 7, 2021, to November 28, 2021, and May 30, 2022, to August 7, 2022

 

RECOMMENDED ACTION(S):

TITLE

Approve application for discharge from accountability, pursuant to Government Code section 25257, for collecting overpayment of wages made to Fresno County Probation Department Supervising Juvenile Correctional Officer Jessica McKenzie, from July 7, 2021, to November 28, 2021, and May 30, 2022, to August 7, 2022, in the total net amount of $29,235.02, and authorize the Chairman to sign resolution providing the discharge.

REPORT

Approval of the recommended action would discharge County officials, including but not limited to the Chief Probation Officer, Auditor-Controller/Treasurer-Tax Collector, County Administrative Officer, Director of Human Resources, and County Counsel, from accountability for collecting $29,235.02 due and payable to the County from Ms. McKenzie.  

 

ALTERNATIVE ACTION(S):

 

Your Board could decide not to approve the recommended action. However, should your Board not approve the recommended action, the County would need to attempt to collect overpayments from Ms. McKenzie. However, the likelihood of collection does not warrant the expense involved.

 

FISCAL IMPACT:

 

The net overpayment of $29,235.02, if collected, would be allocated to the General Fund. However, there is no additional Net County Cost requested with the recommended action because these wages were already paid. Release of accountability for collecting these overpayments is being requested because efforts to collect will likely be futile and will not warrant the expense involved.

 

DISCUSSION:

 

During the period of July 7, 2021, to November 28, 2021, Ms. McKenzie was on a leave of absence and not performing County service. However, due to clerical error and misunderstanding regarding the status of her leave during that period, the County continued to issue Ms. McKenzie her salary in the total amount of $27,825.63, and add annual leave hours to her leave bank for a total of 91.35. She used the 91.35 annual leave hours from May 30, 2022, to August 7, 2022, and was paid in wages for a total of $3,318.29. She was also erroneously underpaid during the November 29, 2021, to December 12, 2021, pay period in the amount of $1,908.90. The net overpayment is therefore $29,235.02 after the underpayment is deducted.
