Recommended Action(s)
1. Retroactively authorize the County Librarian's previous submittal of a grant application for San Joaquin Valley Air Pollution Control District, Public Benefit Grants Program - Clean Air Centers Pilot Program to fund portable air purifiers and filters to improve air quality at seven Library Branch locations; 2. Approve and authorize the Chairman to execute grant agreements with the San Joaquin Valley Air Pollution Control District (G-135552-A1; G-135554-A1; G-135555-A1; G-135556-A1; G-135558-A1; G-135561-A1; and G-135562-A1) to fund portable air purifiers and filters to improve air quality at seven Library Branch locations for a combined maximum total of $159,972; and 3. Authorize the County Librarian, or designee, to execute associated grant related documents to implement and administer the San Joaquin Valley Air Pollution Control District, Public Benefit Grants Program - Clean Air Centers Pilot Program.

SUBJECT:                     San Joaquin Valley Air Pollution Control District Agreements

 

RECOMMENDED ACTION(S):

TITLE

1.                     Retroactively authorize the County Librarian’s previous submittal of a grant application for San Joaquin Valley Air Pollution Control District, Public Benefit Grants Program - Clean Air Centers Pilot Program to fund portable air purifiers and filters to improve air quality at seven Library Branch locations;

 

2.                     Approve and authorize the Chairman to execute grant agreements with the San Joaquin Valley Air Pollution Control District (G-135552-A1; G-135554-A1; G-135555-A1; G-135556-A1; G-135558-A1; G-135561-A1; and G-135562-A1) to fund portable air purifiers and filters to improve air quality at seven Library Branch locations for a combined maximum total of $159,972; and

 

3.                     Authorize the County Librarian, or designee, to execute associated grant related documents to implement and administer the San Joaquin Valley Air Pollution Control District, Public Benefit Grants Program - Clean Air Centers Pilot Program.

REPORT

Approval of the recommended actions will accept grant funding from the San Joaquin Valley Air Pollution Control District (SJVAPCD), Public Benefit Grants Program - Clean Air Centers Pilot (CACP) Program to purchase air purifiers and filters. Approval will also authorize the County Librarian, or designee, to execute any associated grant-related documents. This item is countywide.

 

ALTERNATIVE ACTION(S):

 

Should your Board choose not to accept the grant funding, the grant funds will not be awarded, and the air purifiers and filters will not be purchased.

 

FISCAL IMPACT:

 

There is no additional Net County Cost associated with the recommended actions. The SJVAPCD CACP Program will provide funding for the purchase of 43 air purifiers and 860 filters, on a reimbursement basis, for a combined total of $159,972. Maintenance and use costs will be funded from Measure B and property tax revenue. Sufficient appropriations and estimated revenues are included in the Library’s Org 7511 FY 2023-24 Adopted Budget and will be included in subsequent budget requests.

 

DISCUSSION:

 

SJVAPCD is a public health agency whose mission is to improve the health and quality of life for all Valley residents through efficient, effective, and entrepreneurial air quality-management strategies. The CACP program accepts applications on an ongoing basis to help fund the purchase of air purifiers and filters. The applications are reviewed on a first-come, first-serve basis, and this is an ongoing program until funds are exhausted. The Library will receive reimbursement for the cost of the air purifiers and filters, up to $159,972 total.

 

On September 27, 2022, the County Administrative Officer (CAO) approved the Library’s previous submission of a grant application to the CACP program for the purchase of 43 air purifiers and 860 filters on a reimbursement basis not to exceed $76,785. Per Administrative Policy 27, the CAO has the delegated authority to execute grant applications that do not exceed $100,000 per grant funding cycle on behalf of the Board of Supervisors (Board). In March of 2023 the Library was informed of the discontinuance of a selected model at the Central Library branch. This required the selection of another more expensive model, which resulted in the need for more units and increased the grant funding significantly in excess of $100,000. In April 2023, the Library received notice from SJVAPCD that grant funding in the amount of $159,972 was approved which now requires your Board’s authorization of the previous grant application submittal. Grant funds will not be received prior to acceptance of the second recommended item by your Board.

 

Pursuant to the recommended agreements, the Department must agree to own, operate, and maintain the air purifiers for at least 5 years after they are put into service.

 

The recommended agreements contain one-way indemnification in favor of the SJVAPCD, but the Department believes the benefits associated with entering into the recommended agreements outweigh the associated risks.

 

Approval of the first recommended action will retroactively authorize the Department’s previous submittal of the CACP program grant application.

 

Approval of the second recommended action will authorize the Chairman to execute the recommended agreements to fund the purchase and reimbursement of 43 air purifiers and 860 filters. Approval of the second recommended action delegates authority to the County Librarian or his/her designee to execute any associated grant related documents for the purpose of securing the SJVAPCD grant funds.
